STATE OF NEW YORK ________________________________________________________________________ 6101 2017-2018 Regular Sessions IN SENATE May 11, 2017 ___________ Introduced by Sen. FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the town of Rush, county of Monroe, to use certain property for recreational and educational purposes as well as to lease such property for agricultural use The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other provision of law and notwith- 2 standing the provisions of a deed dated January 12, 2010 and filed in 3 the Monroe county clerk's office in Book 10869 page 606 to the contrary, 4 the town of Rush, county of Monroe, shall be authorized and empowered to 5 use the land described in section two of this act for recreational and 6 educational purposes and shall be authorized and empowered to lease the 7 land described in section two of this act for such consideration and 8 upon such terms, conditions and provisions as shall be mutually agreed 9 upon between the town and the lessee for agricultural purposes. 10 § 2. The lands referenced to in section one of this act shall consist 11 of ALL THAT PIECE or parcel of land situate in the Town of Rush, County 12 of Monroe, State of New York, being a portion of Lot Number 58 in Town- 13 ship Number 11, Range 7 of the Phelps and Gorham Purchase, being bounded 14 and described as follows: 15 Beginning at an iron rod in the northerly bounds of the Scottsville- 16 Rush Road (N.Y.S. Route 251) at its intersection with the division line 17 between the lands, now or formerly, of the National Railway Historical 18 Society, Rochester Chapter, on the east, and the lands of the Town of 19 Rush, on the west; thence along the northerly bounds of the Scotts- 20 ville-Rush Road, the following three (3) courses and distances: 21 1. N. 79° 15' 15" W., a distance of 2,089.79 feet to a point of curva- 22 ture; 23 2. along a curve to the right having a radius of 2,038.24 feet, for an 24 arc length of 276.75 feet to the point of tangency; and EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. N. 71° 28' 28" W., a distance of 45 feet, more or less, to a point 2 on the easterly bank of the Genesee River; thence northerly, along the 3 easterly bank of the Genesee River, the following five (5) courses and 4 distances: 5 1. N. 47° 23' 07" E., a distance of 497.49 feet to a point; 6 2. N. 55° 55' 04" E., a distance of 418.53 feet to a point; 7 3. N. 61° 01' 06" E., a distance of 1,224.56 feet to a point; 8 4. N. 37° 29' 29" E., a distance of 415.29 feet to a point; 9 5. N. 21° 16' 13" E., a distance of 106.37 feet to a point; 10 Thence easterly through the lands of the Town of Rush S. 84° 09' 26" 11 E, a distance of 532.46 feet to a point on the aforementioned division 12 line between lands now or formerly of the National Railway Historical 13 Society, Rochester Chapter on the east and the herein described parcel 14 on the west, thence southerly along said division line the following six 15 (6) courses and distances: 16 1. S. 05° 50' 34" W., a distance of 328.91 feet to a point; 17 2. S. 07° 00' 18" W., a distance of 494.28 feet to a point; 18 3. S. 10° 08' 00" W., a distance of 225.20 feet to a point; 19 4. N. 88° 33' 32" E., a distance of 16.59 feet to a point; 20 5. S. 07° 00' 18" W., a distance of 509.61 feet to a point; and 21 6. S. 07° 37' 47" W., a distance of 472.26 feet to the point or place 22 of beginning, containing 65.2 acres of land, more or less. 23 § 3. This act shall take effect immediately.
