DeFRANCISCO, VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT in relation to authorizing the county of Onondaga to lease certain park property to Syracuse University for Onondaga Lake Park purposes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. (a) Notwithstanding the provisions of any other general, 2 special or local law, rule or regulation to the contrary, the county of 3 Onondaga is hereby authorized and empowered to lease the lands and 4 improvements hereinafter described for up to twenty-five years to Syra- 5 cuse University for such consideration and upon such terms, conditions 6 and provisions as shall be mutually agreed upon by the county and Syra- 7 cuse University consistent with section three of this act. 8 (b) Any revenues received by the county from the lessee shall be used 9 for the capital improvement of Onondaga Lake Park and/or the capital 10 improvement of existing park and recreational facilities and/or for the 11 acquisition of additional park and recreational facilities. 12 S 2. The lands and improvements to be leased pursuant to this act 13 comprise the facility known as the Boathouse and that land immediately 14 adjacent thereto, located at Onondaga Lake Park, county of Onondaga, 15 state of New York, and more particularly described as follows: 16 Beginning at a point on the northerly shoreline of Onondaga Lake 17 Outlet, which is intersected by a line 175' easterly of and parallel to 18 the westernmost building line of the existing Ten Eyck Boathouse; thence 19 northerly along said line a distance of 292' to a point intersected by 20 a line 75' northerly of and parallel to the northernmost building line 21 of said Ten Eyck Boathouse; thence westerly along said line a distance 22 of 195' to a point; thence southerly along a line westerly of and paral- 23 lel to the westernmost building line of said Ten Eyck Boathouse a 24 distance of 55' to a point; thence westerly along a line 20' northerly 25 of and parallel to the northernmost building line of said Ten Eyck Boat- 26 house a distance of 210' to a point; then southerly along a line wester- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14923-01-2 S. 6843 2 1 ly of and parallel to the westernmost building line of said Ten Eyck 2 Boathouse a distance of 245' to a point on the northerly shoreline of 3 Onondaga Lake Outlet; thence easterly along said shoreline to the point 4 and place of beginning, containing 2.5 acres of land more or less, 5 together will all improvements and/or structures situated thereon. 6 The above described lands and improvements are situated on a portion 7 of lands conveyed to the county of Onondaga by GRACE MARGUERITE MAURER 8 as Executrix of the last Will and Testament of BERNIE F. MAURER, 9 Deceased, GRACE MARGUERITE MAURER, Individually residing at 147 Fitch 10 Street, in the City of Syracuse, New York, and KERMIT DRAIS MAURER, her 11 son, residing at 1107 Valley Drive, in the City of Syracuse, New York, 12 WINIFRED E. PECKHAM, of 106 Elk Street, in the City of Syracuse, New 13 York, being heirs at law and next of kin and devisees of Bernhardt Maur- 14 er, Deceased, dated October 18, 1948, and recorded in the Onondaga Coun- 15 ty Clerk's office, February 4, 1950, in Book of Deeds 1427, page 375. 16 S 3. The lands and improvements to be leased pursuant to this act 17 shall be maintained and operated for boating and related recreational 18 activities, providing reasonable public access and use of the public 19 portions of such improvements is permitted during normal public park 20 hours. If the lessee diverts the use of the lands to other than recre- 21 ational and incidental purposes, any lease entered into pursuant to this 22 act shall immediately terminate. 23 S 4. This act shall take effect immediately.
