STATE OF NEW YORK ________________________________________________________________________ 7418 IN SENATE April 29, 2016 ___________ Introduced by Sen. FUNKE -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing a residential parking system in the city of Rochester The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The vehicle and traffic law is amended by adding a new 2 section 1640-p to read as follows: 3 § 1640-p. Residential parking permit system in the city of Rochester. 4 1. Notwithstanding the provisions of any law to the contrary, the city 5 council of the city of Rochester may, by adoption of a local law or 6 ordinance, provide for a residential parking permit system and fix and 7 require the payment of fees applicable to parking within the area in 8 which such parking system is in effect in accordance with the provisions 9 of this section. 10 2. Such residential parking permit system may only be established 11 within the area of the city of Rochester consisting of the following 12 streets: 13 Birch Crescent: From E. Main Street to Goldman Street. 14 Alexander Street: From E. Main Street to Champeney Terrace. 15 Champeney Terrace: From Union Street to Prince Street. 16 Prince Street: From Champeney Terrace to Goldman Street. 17 Kenilworth Terrace: From North Union Street to Prince Street. 18 3. Notwithstanding the foregoing, no permit shall be required on those 19 portions of such streets where the adjacent properties are zoned for 20 commercial/retail use. 21 4. The local law or ordinance providing for such residential parking 22 permit system shall: 23 (a) set forth factors necessitating the enactment of such parking 24 permit system; 25 (b) provide that motor vehicles registered pursuant to section four 26 hundred four-a of this chapter shall be exempt from any permit require- 27 ment; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15093-01-6S. 7418 2 1 (c) provide the times of day and days of the week during which permit 2 requirements shall be in effect; 3 (d) make not less than twenty percent of the spaces within the permit 4 area available to nonresidents, and shall provide short term parking of 5 not less than ninety minutes in duration in the permit area; 6 (e) provide the schedule of fees to be paid for such permits; and 7 (f) provide that such fees shall be credited to the general fund of 8 the city of Rochester. 9 5. No ordinance shall be adopted pursuant to this section until a 10 public hearing thereon has been had in the same manner as required for 11 public hearings on a local law pursuant to the municipal home rule law. 12 § 2. This act shall take effect on the sixtieth day after it shall 13 have become a law.
