STATE OF NEW YORK ________________________________________________________________________ 7462 2021-2022 Regular Sessions IN SENATE October 22, 2021 ___________ Introduced by Sen. HARCKHAM -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the energy law, in relation to providing that one hundred percent of in-state sales of new lawn care devices shall be zero-emissions by two thousand twenty-seven The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The energy law is amended by adding a new section 5-108-b 2 to read as follows: 3 § 5-108-b. Zero-emissions lawn care devices. 1. The commissioner 4 shall promulgate rules and regulations which shall require that all lawn 5 care devices offered for sale or sold, in the state shall be zero-emis- 6 sions by two thousand twenty-seven. For purposes of this section, "lawn 7 care device" shall mean any device powered mechanically, which is 8 intended to be used or is actually used for the mowing of grass, the 9 cutting or chipping of trees, tree roots or tree branches, or the clear- 10 ing of leaves or other vegetation from lawns, sidewalks, public streets 11 or public highways and shall include, but not be limited to, such 12 devices as lawn mowers and lawn mower attachments, lawn edgers, leaf 13 blowers, leaf vacuums, mulchers and chippers. 14 2. The authority, to the extent consistent with federal law, shall 15 develop and propose strategies, in coordination with other state agen- 16 cies and the federal environmental protection agency, to achieve one 17 hundred percent zero-emissions from lawn care device operations in the 18 state by two thousand twenty-seven. In implementing the provisions of 19 this paragraph, the authority shall act consistently with safety, tech- 20 nological feasibility and cost-effectiveness. 21 3. The department, in consultation with the department of economic 22 development, the department of environmental conservation, the public 23 service commission, and other state agencies, local agencies and other 24 interested parties, shall develop a zero-emissions lawn care device EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13404-01-1S. 7462 2 1 market development strategy by January thirty-first, two thousand twen- 2 ty-three, and an update every three years thereafter, that: 3 a. Ensures coordinated and expeditious implementation of the system of 4 policies, programs and regulations necessary to achieve the goals and 5 orders established by this section. 6 b. Outlines state agencies' actions to support new and used zero-emis- 7 sions lawn care device markets for broad accessibility for all residents 8 of this state. 9 4. The authority, the public service commission and other state agen- 10 cies, shall use existing authorities to accelerate deployment of afford- 11 able powering options for zero-emissions lawn care devices, in ways that 12 serve all communities and particularly low-income and disadvantaged 13 communities, consistent with state and federal law. 14 § 2. This act shall take effect immediately.
