THIELE -- read once and referred to the Committee on Local Governments AN ACT to amend chapter 330 of the laws of 2011 amending the town law relating to payments for certain school, fire, fire protection, and ambulance districts for lands exempt from real property taxation for purposes which implement the Peconic Bay community preservation fund, in relation to such payments The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2 of chapter 330 of the laws of 2011 amending the 2 town law relating to payments for certain school, fire, fire protection, 3 and ambulance districts for lands exempt from real property taxation for 4 purposes which implement the Peconic Bay community preservation fund, as 5 amended by chapter 396 of the laws of 2015, is amended to read as 6 follows: 7 § 2. Notwithstanding any provision of law to the contrary, the town of 8 Southampton may make annual payments from its community preservation 9 fund to certain high-tax school, fire, fire protection, and ambulance 10 districts, as specified in this section, located either wholly or 11 partially within the Long Island Pine Barrens maritime reserve as 12 defined in subdivision 2 of section 57-0107 of the environmental conser- 13 vation law. Such payments may be made to mitigate the impact of the 14 lost tax revenues from lands made wholly exempt as a result of their 15 acquisition by the federal, state, or local government for the preserva- 16 tion of community character as defined in subdivision 4 of section 64-e 17 of the town law. The following districts shall be eligible: Riverhead 18 central school district, Hampton Bays union free school district, East- 19 port-South Manor central school district, East Quogue union free school 20 district, Riverhead fire district, Flanders fire district, Flanders - 21 Northampton ambulance district, and the North End Quogue fire protection EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. Payments made pursuant to this section shall not be included 2 in the tax levy for purposes of calculating the tax levy limit pursuant 3 to section 3-c of the general municipal law and section 2023-a of the 4 education law. 5 § 2. This act shall take effect immediately; provided, however, that 6 the amendments to section 2 of chapter 330 of the laws of 2011 made by 7 section one of this act shall not affect the repeal of such section and 8 shall be deemed repealed therewith.
