STATE OF NEW YORK ________________________________________________________________________ 7778 IN SENATE January 11, 2022 ___________ Introduced by Sen. GAUGHRAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public authorities law, in relation to certain reports provided by the Long Island Power Authority The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 1020-kk of the public authorities law, as added by 2 a chapter of the laws of 2021 amending the public authorities law relat- 3 ing to requiring the Long Island Power Authority to prepare a semi-annu- 4 al expenditure and lobbying report, as proposed in legislative bills 5 numbers S. 1311-A and A. 4635, is amended to read as follows: 6 § 1020-kk. Semi-annual expenditure and lobbying report. 1. On or 7 before March thirty-first, two thousand twenty-two and every semi-annual 8 period thereafter[,]: (a) the authority [and its service providers] 9 shall report to the governor, the temporary president of the senate and 10 the speaker of the assembly regarding advertising and lobbying [activ-11ities of] on behalf of the authority by the authority, the trustees of 12 the authority, or any employee of the authority [or]; and (b) any 13 service provider of the authority shall report to the governor, the 14 temporary president of the senate and the speaker of the assembly 15 regarding advertising and lobbying on behalf of the authority, or in 16 connection with the service provider's provision of management and oper- 17 ation services or the operation of the authority's electric transmission 18 and distribution system. 19 2. For the purposes of this title, the following terms shall have the 20 following meanings: 21 (a) Lobbying shall mean any attempt to influence: 22 (i) the passage or defeat of any legislation or resolution by either 23 house of the state legislature including but not limited to the intro- 24 duction or intended introduction of such legislation or resolution or 25 approval or disapproval of any legislation; 26 (ii) the adoption, issuance, rescission[,] or modification [or terms] 27 of a gubernatorial executive order; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD04607-04-2S. 7778 2 1 (iii) the adoption or rejection of any rule or regulation having the 2 force and effect of law by a state agency; 3 (iv) the passage or defeat of any local law, ordinance, resolution, or 4 regulation by any municipality; 5 (v) the adoption, issuance, rescission, modification or terms of any 6 executive order issued by the chief executive officer of a municipality; 7 and 8 (vi) the adoption or rejection of any rule, regulation, or resolution 9 having the force and effect of a local law, ordinance, resolution or 10 regulation. 11 (b) Advertising shall mean any promotional activity or public service 12 announcement that requires the purchase of media space, including tele- 13 vision airtime, radio airtime, internet media space, billboards, newspa- 14 per space, magazine space or any private publication which requires the 15 expenditure of any public funds. 16 3. The authority and its service providers shall prepare separate 17 reports to include the following information: 18 (a) For lobbying, such report shall include, but not be limited to: 19 the name of the trustee, employee of the authority or service provider 20 engaging in lobbying; the name of the public official or public employee 21 that [the trustee] was lobbied; the date and time of the meeting or 22 communication; the subject matter [discussed] of the lobbying, and any 23 expenses incurred by the authority or its service provider for travel, 24 lodging, or meals in connection with such lobbying. 25 (b) For advertising, such report shall include, but not be limited to, 26 itemization of any public funds spent on advertising and information 27 pertaining to the advertising marketing plan including measurable goals 28 and objectives for the advertising campaign. 29 4. The requirements of this section shall not be construed to require 30 the disclosure of information that is otherwise protected from disclo- 31 sure by any law, regulation, order, or the civil practice law and rules. 32 § 2. This act shall take effect on the same date and in the same 33 manner as a chapter of the laws of 2021 amending the public authorities 34 law relating to requiring the Long Island Power Authority to prepare a 35 semi-annual expenditure and lobbying report, as proposed in legislative 36 bills numbers S. 1311-A and A. 4635, takes effect.
