STATE OF NEW YORK ________________________________________________________________________ 8552 IN SENATE June 12, 2020 ___________ Introduced by Sen. KAPLAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT authorizing the county of Nassau to alienate certain lands used as parklands to enable the Port Washington Water District to construct, maintain and operate a water treatment facility The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The county of Nassau is hereby authorized, acting by and 2 through its legislature, and upon such terms and conditions as deter- 3 mined by such legislature, to discontinue as parklands the lands 4 described in section three of this act for the purpose of enabling the 5 Port Washington Water District to construct, maintain and operate a 6 water treatment facility and appurtenances thereto. 7 § 2. The authorization contained in section one of this act shall be 8 effective only upon the condition that the county of Nassau dedicate an 9 amount equal to or greater than the fair market value of the parklands 10 being discontinued for funding of capital improvements, to existing park 11 and recreational facilities. 12 § 3. The lands to be discontinued as parklands and alienated are 13 described as follows: 14 All that certain plot, piece or parcel of land, situate, lying and 15 being at North Hills, Town of North Hempstead, County of Nassau and 16 State of New York, said parcel being more particularly bounded and 17 described as follows: 18 BEGINNING at a point on the easterly line of Searingtown Road, said 19 point being distant northerly the following three (3) courses as meas- 20 ured along said easterly line from its intersection with the old north- 21 erly line of the Westbound Service Road - Long Island Expressway; 22 1. North 11 degrees 02 minutes 30 seconds West, a distance of 246.30 23 feet to a point of curvature; 24 2. Along the arc of a circular curve bearing to the right having a 25 radius of 1660.00 feet and a length of 365.54 feet to point of tangency; 26 3. North 01 degrees 34 minutes 30 seconds East, a distance of 310.00 27 feet; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD16699-01-0S. 8552 2 1 RUNNING THENCE from said point of beginning the following six (6) 2 courses, the first course being along the easterly line of Searingtown 3 Road; 4 1. North 01 degrees 34 minutes 30 seconds East, a distance of 154.22 5 feet; 6 2. South 88 degrees 25 minutes 30 seconds East, a distance of 133.54 7 feet; 8 3. South 01 degrees 34 minutes 30 seconds West, a distance of 158.55 9 feet; 10 4. South 33 degrees 01 minute 56 seconds West, a distance of 102.59 11 feet; 12 5. North 01 degrees 34 minutes 30 seconds East, a distance of 91.84 13 feet; 14 6. North 88 degrees 25 minutes 30 seconds West, a distance of 80.00 15 feet to the easterly line of Searingtown Road and the point or place of 16 BEGINNING. 17 Containing within said bounds 23,169 Sq. Ft. or 0.532 Acres, more or 18 less. 19 § 4. The discontinuance of parklands authorized by the provisions of 20 this act shall not occur until the county of Nassau has complied with 21 any federal requirements pertaining to the alienation or conversion of 22 parklands, including satisfying the secretary of the interior that the 23 alienation or conversion complies with all conditions which the secre- 24 tary of the interior deems necessary to assure the substitution of other 25 lands shall be equivalent in fair market and recreational usefulness to 26 the lands being alienated or converted. 27 § 5. When the lands described in section three of this act cease to be 28 used for the purposes described in section one of this act, those lands 29 shall be restored for park purposes with the cost of restoration being 30 borne by the Port Washington Water District. 31 § 6. This act shall take effect immediately.
