STATE OF NEW YORK ________________________________________________________________________ 8714 IN SENATE March 4, 2024 ___________ Introduced by Sen. BROUK -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to granting peace officer status to certain security officers employed by Roches- ter Regional Health or its subsidiaries The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2.10 of the criminal procedure law is amended by 2 adding a new subdivision 86 to read as follows: 3 86. Officers and members of the security force employed by Rochester 4 Regional Health. Peace officers employed by Rochester Regional Health or 5 its subsidiaries shall have the powers of peace officers within the 6 geographic area of employment of the grounds or premises owned, 7 controlled or administered by Rochester Regional Health or its subsid- 8 iaries, on any public street and sidewalk that abuts the grounds, build- 9 ings or property of such geographic area, and beyond such geographic 10 area upon the request of the chief law enforcement officer of the local 11 law enforcement jurisdiction or his or her designee, for the purpose of 12 transporting an individual who has been arrested in accordance with 13 section 140.27 of this chapter and where no local law enforcement offi- 14 cer is available for transporting such individual in a timely manner. 15 Such peace officers shall only have the powers listed in paragraphs (a), 16 (b), (c), (d), (e), and (h) of subdivision one of section 2.20 of this 17 article, and the power to detain an individual for a reasonable period 18 of time while awaiting the arrival of law enforcement, provided that 19 such peace officer has actual knowledge, or probable cause to believe, 20 that such individual has committed an offense; provided however, that 21 nothing in this subdivision shall be deemed to authorize such officer to 22 carry, possess, repair or dispose of a firearm unless the appropriate 23 license therefor has been issued pursuant to section 400.00 of the penal 24 law. 25 § 2.
