an appropriation. | 8 |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 126.33 of the Revised Code be | 9 |
enacted to read as follows: | 10 |
Sec. 126.33. (A) As used in this section: | 11 |
(1) "Subdivision" means a county, township, or municipal | 12 |
corporation. | 13 |
(2) "Maximum allowable award" means the sum of the following | 14 |
amounts: | 15 |
(a) The amount the subdivision received from the local | 16 |
government fund in state fiscal year 2011 minus the amount the | 17 |
subdivision received from the local government fund in state | 18 |
fiscal year 2012; plus | 19 |
(b) The amount the subdivision received from the local | 20 |
government fund in state fiscal year 2011 minus the amount the | 21 |
subdivision received from the local government fund in state | 22 |
fiscal year 2013. | 23 |
(B) There is hereby created in the state treasury the local | 24 |
government bridge fund, which shall consist of money appropriated | 25 |
to the fund. The director of budget and management shall use money | 26 |
in the fund to award grants to subdivisions as provided in this | 27 |
section. | 28 |
(C) A subdivision may apply to the director of budget and | 29 |
management, in the manner prescribed by the director, to receive a | 30 |
grant from the local government bridge fund. A subdivision may not | 31 |
apply for a grant in excess of the subdivision's maximum allowable | 32 |
award. The director shall approve a subdivision for a grant from | 33 |
the fund if, to the director's satisfaction, the applicant | 34 |
subdivision establishes or provides all of the following: | 35 |
(1) Evidence that, without funding from the local government | 36 |
bridge fund, the applicant subdivision will be required to reduce | 37 |
the level of services provided directly to residents of the | 38 |
subdivision in the subdivision's following fiscal year compared | 39 |
with the level of such services provided in the subdivision's | 40 |
current fiscal year. In determining the level of such services, | 41 |
any costs related to the internal administrative organization of | 42 |
the subdivision shall be excluded. | 43 |
(2) Evidence that any growth in the applicant subdivision's | 44 |
general fund budget has been proportionate to or proportionately | 45 |
less than the subdivision's growth in population over the ten | 46 |
preceding fiscal years. If the growth in the subdivision's general | 47 |
fund budget is proportionally greater than the growth in the | 48 |
subdivision's population, the subdivision shall provide a written | 49 |
explanation of the reasons for such disproportionate growth. | 50 |
(3) A written plan for developing and implementing, within | 51 |
two years, measures that would reduce the applicant subdivision's | 52 |
costs and increase its efficiency for the purpose of balancing | 53 |
future budgets or that would increase collaboration with other | 54 |
subdivisions to share services and reduce costs. If state law | 55 |
would impede a plan submitted under division (C)(3) of this | 56 |
section from being effective, the subdivision shall submit the | 57 |
plan assuming that state law was amended to remove the impediment | 58 |
and shall provide an explanation of amendments to state law that | 59 |
would need to be enacted before the plan could be effective. | 60 |
(D) The director shall award to each approved applicant a | 61 |
grant up to the subdivision's maximum allowable award. | 62 |
(E) The director may require, as a condition of receiving a | 63 |
grant under this section, that an approved applicant agree to be | 64 |
subject to a performance audit by the auditor of state conducted | 65 |
pursuant to Chapter 117. of the Revised Code. The costs of any | 66 |
performance audit shall be paid by the subdivision to the auditor | 67 |
of state from the money awarded to the subdivision under this | 68 |
section. | 69 |
Section 2. The Director of Budget and Management shall | 70 |
prescribe guidelines and forms for the grant program described in | 71 |
section 126.33 of the Revised Code on or before September 30, | 72 |
2013, and shall accept applications from subdivisions for grants | 73 |
between October 1, 2013, and October 31, 2013. The Director shall | 74 |
notify applying subdivisions whether or not the subdivision will | 75 |
be awarded a grant and the amount of any awarded grant on or | 76 |
before November 30, 2013. The Director shall distribute awarded | 77 |
grant money to approved subdivisions between January 1, 2014, and | 78 |
January 31, 2014. | 79 |
Section 3. All items in this section are hereby appropriated | 80 |
as designated out of any moneys in the state treasury to the | 81 |
credit of the designated fund. For all appropriations made in this | 82 |
act, those in the first column are for fiscal year 2014 and those | 83 |
in the second column are for fiscal year 2015. The appropriations | 84 |
made in this act are in addition to any other appropriations made | 85 |
for the FY 2014-FY 2015 biennium. | 86 |

The foregoing appropriation item 042612, Local Government | 93 |
Bridge Grants, shall be used to distribute grants pursuant to | 94 |
section 126.33 of the Revised Code, as enacted by this act. | 95 |
On December 31, 2013, or as soon as possible thereafter, the | 96 |
Director of Budget and Management shall transfer $200,000,000 cash | 97 |
from the General Revenue Fund to the Local Government Bridge Fund | 98 |
(Fund 5ME0), created in section 126.33 of the Revised Code, as | 99 |
enacted by this act. | 100 |
Section 4. Within the limits set forth in this act, the | 101 |
Director of Budget and Management shall establish accounts | 102 |
indicating the source and amount of funds for each appropriation | 103 |
made in this act, and shall determine the form and manner in which | 104 |
appropriation accounts shall be maintained. Expenditures from | 105 |
appropriations contained in this act shall be accounted for as | 106 |
though made in the main operating appropriations act of the 130th | 107 |
General Assembly. | 108 |
The appropriations made in this act are subject to all | 109 |
provisions of the main operating appropriations act of the 130th | 110 |
General Assembly that are generally applicable to such | 111 |
appropriations. | 112 |
