A BILL
To amend sections 4725.42 and 4725.43 of the Revised 1
Code to modify the composition of the Optical 2
Dispensers Board.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 4725.42 and 4725.43 of the Revised 4
Code be amended to read as follows:5

       Sec. 4725.42.  (A) There is hereby created the Ohio optical 6
dispensers board, consisting of nineseven members as follows:7

       (1) Five licensed dispensing opticians, at least one of whom 8
shall be a licensed contact lens dispensing optician and at least 9
one of whom shall be a licensed spectacle dispensing optician, 10
licensed under sections 4725.48 to 4725.51 of the Revised Code, 11
except as otherwise provided in this division;12

       (2) One individual who is either an optometrist licensed by 13
the state board of optometry or a physician licensedauthorized by 14
the state medical board to practice medicine and surgery or 15
osteopathic medicine and surgery who engages in the practice of 16
ophthalmology;17

       (3) One optometrist licensed by the state board of optometry;18

       (4) Two membersmember of the public who havehas no direct 19
financial interest in or any other interest in the provision of 20
optical aids or the performance of optical dispensing services. At 21
least one of these members of the public shall be at least sixty 22
years of age.23

       The initial dispensing optician members of the board shall 24
meet the criteria for licensure as licensed dispensing opticians 25
specified in section 4725.47 of the Revised Code.26

       (B) The governor, with the advice and consent of the senate, 27
shall make appointments to the board. Terms of office shall be for 28
five years, each term commencing on the twenty-third day of March 29
and ending on the twenty-second day of March. EachA member of the 30
board shall hold office from the date of histhe member's31
appointment until the end of the term for which hethe member was 32
appointed, except that if a successor member has not been 33
appointed by the end of the term, the member shall continue in 34
office until such appointment.35

       No member shall serve more than two consecutive terms. Any 36
vacancy occurring prior to the expiration of a member's term shall 37
be filled in the same manner as the original appointment. A member 38
appointed to fill a vacancy shall hold office for the remainder of 39
the unexpired term of the predecessor member of the board.40

       Sec. 4725.43.  The Ohio optical dispensers board shall elect 41
a president and such other officers from its members, as may be 42
prescribed by rule. The officers of the board shall hold their 43
respective offices for a term of one year.44

       The board shall meet at least once in each calendar year in 45
Columbus. A majority of the board shall constitute a quorum for 46
the purpose of conducting business of the board. No action of the 47
board is valid without the concurrence of fivefour members. The 48
board shall also meet at such additional times and in such places 49
as are specified by rule or directed by the president, or pursuant 50
to a written request submitted to the executive 51
secretary-treasurer by two other officers or by any two members.52

       Section 2.  That existing sections 4725.42 and 4725.43 of the 53
Revised Code are hereby repealed.54

       Section 3. The amendment made by this act to section 4725.42 55
of the Revised Code providing for a reduction in the Ohio Optical 56
Dispensers Board does not affect the members holding office on the 57
effective date of this act. The reduction shall be implemented by 58
not filling vacancies that correspond with the changes made by 59
this act to the Board's membership.60
