A BILL
To enact section 5533.00 of the Revised Code to 1
require supportive resolutions from affected local 2
governments to name highways by statute, to allow 3
local governments to erect appropriate markers 4
naming highways, and to prohibit the use of state 5
funds to erect new markers naming state highways.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5533.00 of the Revised Code be 7
enacted to read as follows:8

       Sec. 5533.00.  (A)(1) Legislation proposing enactment by 9
statute of a distinctive name for a bridge or a portion of a 10
highway shall be supported by a resolution from the governing 11
legislative body of each county, township, or municipal 12
corporation in which the bridge is located or through which the 13
portion of the highway being named extends, endorsing the proposed 14
name.15

       (2) Except as may otherwise be specifically provided by law, 16
after the effective date of this section, the director of 17
transportation shall not be required to implement any legislation 18
that names a bridge or a portion of a state highway unless the 19
proposed name is supported by a resolution from the governing 20
legislative body of each county, township, or municipal 21
corporation in which the bridge is located or through which the 22
portion of the state highway being named extends.23

       (B)(1) The director of transportation may erect markers along 24
a bridge or state highway indicating a name enacted by statute 25
that becomes effective after the effective date of this section 26
only if the department of transportation receives contributions 27
sufficient to pay all costs of manufacturing, erecting, and 28
maintaining the markers. The department shall not accept 29
contributions under this section unless it first has determined 30
that placement of the markers at the designated location is 31
permissible under applicable laws and in accordance with the 32
directives for the signing of named memorial highways in the 33
manual adopted by the department under section 4511.09 of the 34
Revised Code. Any money received by the department for these 35
purposes shall be deposited into the state treasury to the credit 36
of the state highway operating fund. The department may continue 37
to repair, replace, and maintain any markers in place on the 38
effective date of this section without receiving contributions to 39
pay such costs.40

       (2) Any county, township, or municipal corporation that 41
supports by a resolution a name for the bridge or highway enacted 42
by statute, at its own expense, may erect markers indicating the 43
name of the bridge or highway within its own jurisdiction, but any 44
marker so erected shall be permissible under applicable laws and 45
in accordance with the directives for the signing of named 46
memorial highways in the manual adopted by the department of 47
transportation under section 4511.09 of the Revised Code.48
