A BILL
To amend section 4501.21 and to enact section 1
4503.499 of the Revised Code to create "Special 2
Olympics" license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.499 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.50, 4503.501, 4503.502, 4503.51, 10
4503.522, 4503.523, 4503.545, 4503.55, 4503.551, 4503.552, 11
4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 4503.68, 12
4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 4503.74, 13
4503.75, 4503.85, and 4503.92 of the Revised Code. 14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows: 16

        The registrar shall pay the contributions received pursuant 17
to section 4503.491 of the Revised Code to the breast cancer fund 18
of Ohio, which shall use that money only to pay for programs that 19
provide assistance and education to Ohio breast cancer patients 20
and that improve access for such patients to quality health care 21
and clinical trials and shall not use any of the money for 22
abortion information, counseling, services, or other 23
abortion-related activities. 24

        The registrar shall pay the contributions received pursuant 25
to section 4503.493 of the Revised Code to the autism society of 26
Ohio, which shall use the contributions for programs and autism 27
awareness efforts throughout the state. 28

       The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.499 of the Revised Code to 30
special olympics, inc., which shall use the contributions for its 31
programs, charitable efforts, and other activities.32

        The registrar shall pay the contributions the registrar 33
receives pursuant to section 4503.50 of the Revised Code to the 34
future farmers of America foundation, which shall deposit the 35
contributions into its general account to be used for educational 36
and scholarship purposes of the future farmers of America 37
foundation. 38

        The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.501 of the Revised Code to the 40
4-H youth development program of the Ohio state university 41
extension program, which shall use those contributions to pay the 42
expenses it incurs in conducting its educational activities. 43

        The registrar shall pay the contributions received pursuant 44
to section 4503.502 of the Revised Code to the Ohio cattlemen's 45
foundation, which shall use those contributions for scholarships 46
and other educational activities. 47

        The registrar shall pay each contribution the registrar 48
receives pursuant to section 4503.51 of the Revised Code to the 49
university or college whose name or marking or design appears on 50
collegiate license plates that are issued to a person under that 51
section. A university or college that receives contributions from 52
the fund shall deposit the contributions into its general 53
scholarship fund. 54

        The registrar shall pay the contributions the registrar 55
receives pursuant to section 4503.522 of the Revised Code to the 56
"friends of Perry's victory and international peace memorial, 57
incorporated," a nonprofit corporation organized under the laws of 58
this state, to assist that organization in paying the expenses it 59
incurs in sponsoring or holding charitable, educational, and 60
cultural events at the monument. 61

       The registrar shall pay the contributions the registrar 62
receives pursuant to section 4503.523 of the Revised Code to the 63
fairport lights foundation, which shall use the money to pay for 64
the restoration, maintenance, and preservation of the lighthouses 65
of fairport harbor. 66

        The registrar shall pay the contributions the registrar 67
receives pursuant to section 4503.55 of the Revised Code to the 68
pro football hall of fame, which shall deposit the contributions 69
into a special bank account that it establishes and which shall be 70
separate and distinct from any other account the pro football hall 71
of fame maintains, to be used exclusively for the purpose of 72
promoting the pro football hall of fame as a travel destination. 73

        The registrar shall pay the contributions that are paid to 74
the registrar pursuant to section 4503.545 of the Revised Code to 75
the national rifle association foundation, which shall use the 76
money to pay the costs of the educational activities and programs 77
the foundation holds or sponsors in this state. 78

        The registrar shall pay to the Ohio pet fund the 79
contributions the registrar receives pursuant to section 80
4503.551 of the Revised Code and any other money from any 81
other source, including donations, gifts, and grants, that is 82
designated by the source to be paid to the Ohio pet fund. The 83
Ohio pet fund shall use the moneys it receives under this 84
section to support programs for the sterilization of dogs and 85
cats and for educational programs concerning the proper 86
veterinary care of those animals, and for expenses of the Ohio 87
pet fund that are reasonably necessary for it to obtain and 88
maintain its tax-exempt status and to perform its duties. 89

        The registrar shall pay the contributions the registrar 90
receives pursuant to section 4503.552 of the Revised Code to the 91
rock and roll hall of fame and museum, incorporated. 92

        The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.553 of the Revised Code to the 94
Ohio coalition for animals, incorporated, a nonprofit corporation. 95
Except as provided in division (B) of this section, the coalition 96
shall distribute the money to its members, and the members shall 97
use the money only to pay for educational, charitable, and other 98
programs of each coalition member that provide care for unwanted, 99
abused, and neglected horses. The Ohio coalition for animals may 100
use a portion of the money to pay for reasonable marketing costs 101
incurred in the design and promotion of the license plate and 102
for administrative costs incurred in the disbursement and 103
management of funds received under this section. 104

        The registrar shall pay the contributions the registrar 105
receives pursuant to section 4503.561 of the Revised Code to the 106
state of Ohio chapter of ducks unlimited, inc., which shall 107
deposit the contributions into a special bank account that it 108
establishes. The special bank account shall be separate and 109
distinct from any other account the state of Ohio chapter of ducks 110
unlimited, inc., maintains and shall be used exclusively for the 111
purpose of protecting, enhancing, restoring, and managing wetlands 112
and conserving wildlife habitat. The state of Ohio chapter of 113
ducks unlimited, inc., annually shall notify the registrar in 114
writing of the name, address, and account to which such payments 115
are to be made. 116

        The registrar shall pay the contributions the registrar 117
receives pursuant to section 4503.562 of the Revised Code to the 118
Mahoning river consortium, which shall use the money to pay the 119
expenses it incurs in restoring and maintaining the Mahoning 120
river watershed. 121

        The registrar shall pay to a sports commission created 122
pursuant to section 4503.591 of the Revised Code each 123
contribution the registrar receives under that section that an 124
applicant pays to obtain license plates that bear the logo of a 125
professional sports team located in the county of that sports 126
commission and that is participating in the license plate program 127
pursuant to division (E) of that section, irrespective of the 128
county of residence of an applicant. 129

        The registrar shall pay to a community charity each 130
contribution the registrar receives under section 4503.591 of the 131
Revised Code that an applicant pays to obtain license plates that 132
bear the logo of a professional sports team that is participating 133
in the license plate program pursuant to division (G) of that 134
section. 135

        The registrar shall pay the contributions the registrar 136
receives pursuant to section 4503.67 of the Revised Code to the 137
Dan Beard council of the boy scouts of America. The council shall 138
distribute all contributions in an equitable manner throughout 139
the state to regional councils of the boy scouts. 140

        The registrar shall pay the contributions the registrar 141
receives pursuant to section 4503.68 of the Revised Code to the 142
great river council of the girl scouts of the United States of 143
America. The council shall distribute all contributions in an 144
equitable manner throughout the state to regional councils of the 145
girl scouts. 146

        The registrar shall pay the contributions the registrar 147
receives pursuant to section 4503.69 of the Revised Code to the 148
Dan Beard council of the boy scouts of America. The council shall 149
distribute all contributions in an equitable manner throughout 150
the state to regional councils of the boy scouts. 151

        The registrar shall pay the contributions the registrar 152
receives pursuant to section 4503.71 of the Revised Code to the 153
fraternal order of police of Ohio, incorporated, which shall 154
deposit the fees into its general account to be used for purposes 155
of the fraternal order of police of Ohio, incorporated. 156

        The registrar shall pay the contributions the registrar 157
receives pursuant to section 4503.711 of the Revised Code to the 158
fraternal order of police of Ohio, incorporated, which shall 159
deposit the contributions into an account that it creates to be 160
used for the purpose of advancing and protecting the law 161
enforcement profession, promoting improved law enforcement 162
methods, and teaching respect for law and order. 163

       The registrar shall pay the contributions received pursuant 164
to section 4503.712 of the Revised Code to Ohio concerns of 165
police survivors, which shall use those contributions to provide 166
whatever assistance may be appropriate to the families of Ohio 167
law enforcement officers who are killed in the line of duty. 168

       The registrar shall pay the contributions the registrar 169
receives pursuant to section 4503.72 of the Revised Code to the 170
organization known on March 31, 2003, as the Ohio CASA/GAL 171
association, a private, nonprofit corporation organized under 172
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 173
shall use these contributions to pay the expenses it incurs in 174
administering a program to secure the proper representation in the 175
courts of this state of abused, neglected, and dependent children, 176
and for the training and supervision of persons participating in 177
that program. 178

        The registrar shall pay the contributions the registrar 179
receives pursuant to section 4503.73 of the Revised Code to 180
Wright B. Flyer, incorporated, which shall deposit the 181
contributions into its general account to be used for purposes of 182
Wright B. Flyer, incorporated. 183

       The registrar shall pay the contributions the registrar 184
receives pursuant to section 4503.74 of the Revised Code to the 185
Columbus zoological park association, which shall disburse the 186
moneys to Ohio's major metropolitan zoos, as defined in section 187
4503.74 of the Revised Code, in accordance with a written 188
agreement entered into by the major metropolitan zoos. 189

       The registrar shall pay the contributions the registrar 190
receives pursuant to section 4503.75 of the Revised Code to the 191
rotary foundation, located on March 31, 2003, in Evanston, 192
Illinois, to be placed in a fund known as the permanent fund and 193
used to endow educational and humanitarian programs of the rotary 194
foundation. 195

        The registrar shall pay the contributions the registrar 196
receives pursuant to section 4503.85 of the Revised Code to the 197
Ohio sea grant college program to be used for Lake Erie area 198
research projects. 199

       The registrar shall pay the contributions received pursuant 200
to section 4503.92 of the Revised Code to support our troops, 201
incorporated, a national nonprofit corporation, which shall use 202
those contributions in accordance with its articles of 203
incorporation and for the benefit of servicemembers of the armed 204
forces of the United States and their families when they are in 205
financial need. 206

       (C) All investment earnings of the license plate contribution 207
fund shall be credited to the fund. Not later than the first day 208
of May of every year, the registrar shall distribute to each 209
entity described in division (B) of this section the investment 210
income the fund earned the previous calendar year. The amount of 211
such a distribution paid to an entity shall be proportionate to 212
the amount of money the entity received from the fund during the 213
previous calendar year. 214

       Sec. 4503.499. (A) The owner or lessee of any passenger car,215
noncommercial motor vehicle, recreational vehicle, or other 216
vehicle of a class approved by the registrar of motor vehicles may 217
apply to the registrar for the registration of the vehicle and 218
issuance of special olympics license plates. An application made 219
under this section may be combined with a request for a special 220
reserved license plate under section 4503.40 or 4503.42 of the 221
Revised Code. Upon receipt of the completed application and 222
compliance by the applicant with divisions (B) and (C) of this 223
section, the registrar shall issue to the applicant the 224
appropriate vehicle registration and a set of special olympics225
license plates and a validation sticker, or a validation sticker 226
alone when required by section 4503.191 of the Revised Code. 227

       In addition to the letters and numbers ordinarily inscribed228
on the license plates, special olympics license plates shall be 229
inscribed with identifying words or markings that are designed by 230
special olympics, inc. and are approved by the registrar. Special 231
olympics license plates shall display county identification 232
stickers that identify the county of registration by name or 233
number.234

       (B) The special olympics license plates and a validation 235
sticker, or validation sticker alone, shall be issued upon236
receipt of a contribution as provided in division (C) of this237
section and upon payment of the regular license tax as prescribed238
under section 4503.04 of the Revised Code, any applicable motor239
vehicle license tax levied under Chapter 4504. of the Revised240
Code, any applicable additional fee prescribed by section 4503.40 241
or 4503.42 of the Revised Code, a fee of ten dollars for the 242
purpose of compensating the bureau of motor vehicles for 243
additional services required in the issuing of special olympics244
license plates, and compliance with all other applicable laws 245
relating to the registration of motor vehicles.246

       (C) For each application for registration and registration247
renewal notice the registrar receives under this section, the248
registrar shall collect a contribution of fifteen dollars. The249
registrar shall transmit this contribution to the treasurer of250
state for deposit in the license plate contribution fund created 251
in section 4501.21 of the Revised Code.252

       The registrar shall transmit the additional fee of ten253
dollars paid to compensate the bureau for the additional services254
required in the issuing of special olympics license plates to 255
the treasurer of state for deposit into the state treasury to the 256
credit of the state bureau of motor vehicles fund created by 257
section 4501.25 of the Revised Code.258

       Section 2.  That existing section 4501.21 of the Revised Code 259
is hereby repealed.260
