A BILL
To amend sections 4742.02, 4742.03, 4742.04, 4742.05, 1
and 4742.06, to amend, for the purpose of adopting 2
new section numbers as shown in parentheses, 3
sections 4742.02 (4742.03), 4742.03 (4742.04), 4
4742.04 (4742.05), 4742.05 (4742.06), and 4742.06 5
(4742.07), and to enact new section 4742.02 of the 6
Revised Code to require certification of emergency 7
service telecommunicators and modify training 8
requirements.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 4742.02, 4742.03, 4742.04, 4742.05, 10
and 4742.06 be amended, that sections 4742.02 (4742.03), 4742.03 11
(4742.04), 4742.04 (4742.05), 4742.05 (4742.06), and 4742.06 12
(4742.07) be amended for the purpose of adopting new section 13
numbers as shown in parentheses, and that new section 4742.02 of 14
the Revised Code be enacted to read as follows:15

       Sec. 4742.02.  No emergency service provider shall employ an 16
emergency service telecommunicator who is not certified under 17
section 4742.04, 4742.05, or 4742.07 of the Revised Code.18

       Sec. 4742.02.        Sec. 4742.03.  (A) The state board of education, in 19
conjunction with emergency service providers, shall develop a 20
program to provide emergency service telecommunicator training, 21
and shall implement the program not more than one year after the 22
effective date of this sectionNovember 5, 1997. In developing the 23
program, the state board and the emergency service providers shall 24
accept and consider suggestions from any political subdivision or 25
other entity, whether located within or outside of this state, 26
that offers suggestions. The program shall include all of the 27
following:28

       (1) A curriculum for a basic course of emergency service 29
telecommunicator training that conforms to the requirements of 30
division (A) of section 4742.034742.04 of the Revised Code;31

       (2) A curriculum for continuing education coursework in 32
emergency service telecommunicator training that conforms to the 33
requirements of division (B)(C) of section 4742.034742.04 of the 34
Revised Code;35

       (3) Standards and examinations to be used in the program to 36
certify that a person has successfully completed a basic course 37
of, or continuing education coursework in, emergency service 38
telecommunicator training;39

       (4) Implementation of the training program at vocational 40
education centers that are approved by the board to offer 41
vocational education;42

       (5) The provision at least eight times per year of a basic 43
course of emergency service telecommunicator training at different 44
vocational education centers around this state selected to 45
reasonably accommodate persons requesting the training;46

       (6) A requirement that any employee of an emergency service 47
provider may enroll in and complete any course offered under the 48
program at no charge by the state board to the employee or 49
provider. The tuition and materials costs for training such 50
employees under the program shall be paid from the emergency 51
service telecommunicator training fund created under division (B) 52
of this section.53

       (7) A requirement that space available in each basic course 54
offered by the state board shall be allocated on a priority basis, 55
first to unpaid volunteers of emergency service providers, second 56
to paid volunteers of such providers, and third to other persons;57

       (8) A provision allowing persons who are not employees of 58
emergency service providers to enroll in any course offered under 59
the program, on a space-available basis. The state board may 60
charge reasonable tuition to such persons to attend the course.61

       (B) The emergency service telecommunicator training fund is 62
hereby established in the state treasury. The state board of 63
education shall use money in the fund only for the following 64
purposes:65

       (1) To develop the emergency service telecommunicator 66
training program required under division (A) of this section;67

       (2) To pay the compensation of state board of education 68
employees who administer the program and the state board's costs 69
of training employees of emergency service providers at courses 70
offered under the program.71

       (C) The state board of education, in accordance with Chapter 72
119. of the Revised Code, shall adopt rules necessary to develop 73
and administer the training program under this section.74

       Sec. 4742.03.        Sec. 4742.04.  (A) A person may obtain certification 75
as an emergency service telecommunicator by successfully 76
completing a basic course of emergency service telecommunicator 77
training that is conducted by the state board of education under 78
section 4742.024742.03 of the Revised Code. The basic course of 79
emergency service telecommunicator training shall include, but not 80
be limited to, both of the following:81

       (1) At leastBetween forty and sixty hours of instruction or 82
training that, at minimum, conform to the project 33 revised 83
minimum training standards for public safety telecommunicators of 84
the association of public-safety communications officials;85

       (2) Instructional or training units in all of the following 86
subjects:87

       (a) The role of the emergency service telecommunicator;88

       (b) Effective communication skills;89

       (c) Emergency service telecommunicator liability;90

       (d) Telephone techniques;91

       (e) Requirements of the "Americans With Disabilities Act of 92
1990," 104 Stat. 327, 42 U.S.C. 12101, as amended, that pertain to 93
emergency service telecommunicators;94

       (f) Handling hysterical and suicidal callers;95

       (g) Protocol for submerged-vehicle situations and other 96
situations where an individual's life is immediately endangered;97

        (h) Law enforcement terminology;98

       (h)(i) Fire service terminology;99

       (i)(j) Emergency medical service terminology;100

       (j)(k) Emergency call processing guides for law enforcement;101

       (k)(l) Emergency call processing guides for fire service;102

       (l)(m) Emergency call processing guides for emergency medical 103
service;104

       (m)(n) Radio broadcast techniques;105

       (n)(o) Disaster planning;106

       (o)(p) Police officer survival, fire or emergency medical 107
service scene safety, or both police officer survival and fire or 108
emergency medical service scene safety.109

       (B) In developing protocol required under division (A)(2)(g) 110
of this section, the state board of education shall consult 111
training requirements established for all of the following:112

        (1) For peace officers, under section 109.74 of the Revised 113
Code;114

        (2) For emergency medical service personnel, as defined in 115
section 4765.01 of the Revised Code;116

        (3) For firefighters, as established by the firefighter and 117
fire safety inspector training committee of the state board of 118
emergency medical services created under section 4765.04 of the 119
Revised Code.120

       (C) A person may maintain certification as an emergency 121
service telecommunicator by successfully completing at least eight 122
hours of continuing education coursework in emergency service 123
telecommunicator training during each two-year period after a 124
person first obtains the certification referred to in division (A) 125
of this section. The continuing education coursework shall consist 126
of review and advanced training and instruction in the subjects 127
listed in division (A)(2) of this section.128

       (C)(D) If a person successfully completes the basic course of 129
emergency service telecommunicator training described in division 130
(A) of this section, the state board of education or a designee of 131
the board shall certify the person's successful completion. The 132
board shall send a copy of the certification to the person and to 133
the emergency service provider by whom the person is employed.134

       If a person successfully completes the continuing education 135
coursework described in division (B)(C) of this section, the state 136
board of education or a designee of the board shall certify the 137
person's successful completion. The board shall send a copy of the 138
certification to the person and to the emergency service provider 139
by whom the person is employed.140

       Sec. 4742.04.        Sec. 4742.05.  (A) A person may obtain certification 141
as an emergency service telecommunicator by successfully 142
completing a basic course of emergency service telecommunicator 143
training that is conducted by or under the direction of an 144
emergency service provider. Prior to such a course being 145
conducted, the emergency service provider shall certify that the 146
course meets the requirements of division (A) of section 4742.03147
4742.04 of the Revised Code. If a person successfully completes 148
the course, the emergency service provider shall certify the 149
person's successful completion.150

       (B) A person may maintain certification as an emergency 151
service telecommunicator by successfully completing continuing 152
education coursework in emergency service telecommunicator 153
training that is conducted by or under the direction of an 154
emergency service provider. Prior to such coursework being 155
conducted, the emergency service provider shall certify that the 156
coursework meets the requirements of division (B)(C) of section 157
4742.034742.04 of the Revised Code. If a person successfully 158
completes the coursework, the emergency service provider shall 159
certify the person's successful completion.160

       (C) Upon certification of a person under division (A) or (B) 161
of this section, the emergency service provider that certifies the 162
person shall send a copy of the certification to the person and to 163
the emergency service provider by whom the person is employed 164
unless the emergency service provider certifying the person is the 165
person's employer.166

       Sec. 4742.05.        Sec. 4742.06.  (A) A career school that holds a valid 167
certificate of registration from the state board of career 168
colleges and schools may apply to the state board of education for 169
certification of a basic course of emergency service 170
telecommunicator training or of continuing education coursework in 171
emergency service telecommunicator training. The state board of 172
education shall prescribe the form of the application.173

       (B) Upon receipt of an application, the state board of 174
education shall review it and consider whether the proposed course 175
or coursework meets the requirements of division (A) or (B)(C) of 176
section 4742.034742.04 of the Revised Code concerning course 177
length and content. If the proposed course or coursework meets 178
those requirements, the state board of education shall issue a 179
certification of that fact to the career school. Inclusion of 180
on-site verifiable electronic training as part of a proposed basic 181
or continuing education course shall not be a reason for the state 182
board to deny certification.183

       (C) If, after receiving a certification from the state board 184
of education under this section, the career school changes the 185
approved course or coursework, the prior certification is canceled 186
and the career school shall apply to the state board of education 187
for certification of the changed course or coursework.188

       Sec. 4742.06.        Sec. 4742.07.  (A) A person may obtain certification 189
as an emergency service telecommunicator by successfully 190
completing a basic course of emergency service telecommunicator 191
training that is conducted by a career school that has obtained 192
certification of that course from the state board of education 193
under section 4742.054742.06 of the Revised Code. If a person 194
successfully completes the course, the career school shall certify 195
the person's successful completion.196

       (B) A person may maintain certification as an emergency 197
service telecommunicator by successfully completing continuing 198
education coursework in emergency service telecommunicator 199
training that is conducted by a career school that has obtained 200
certification of that coursework from the state board of education 201
under section 4742.054742.06 of the Revised Code. If a person 202
successfully completes the coursework, the career school shall 203
certify the person's successful completion.204

       (C) Upon certification of a person's successful completion 205
under division (A) or (B) of this section, the career school shall 206
send a copy of the certification to the person and to the 207
emergency service provider that employs the person.208

       (D) Tuition and materials costs for a person enrolled in a 209
certified basic or continuing education course conducted by a 210
career school shall be paid by the person, an emergency service 211
provider, or any other entity on behalf of the person or an 212
emergency service provider.213

       Section 2.  That existing sections 4742.02, 4742.03, 4742.04, 214
4742.05, and 4742.06 of the Revised Code are hereby repealed.215
