Bill Title: To provide that a property owner or a representative of a property owner who knowingly permits another person or persons to inhabit a property that the person knows to have been determined to be uninhabitable by a municipal, township, county, or state authority and the person or persons are killed as a proximate result of engaging in an activity that a reasonable person would engage in to alleviate the uninhabitable condition is guilty of negligent homicide.

A BILL
To amend section 2903.05 of the Revised Code to 1
provide that a property owner or a representative 2
of a property owner who knowingly permits another 3
person or persons to inhabit a property that the 4
person knows to have been determined to be 5
uninhabitable by a municipal, township, county, or 6
state authority and the person or persons are 7
killed as a proximate result of engaging in an 8
activity that a reasonable person would engage in 9
to alleviate the uninhabitable condition is guilty 10
of negligent homicide.11


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2903.05 of the Revised Code be 12
amended to read as follows:13

       Sec. 2903.05.  (A) No person shall negligently cause the 14
death of another or the unlawful termination of another's 15
pregnancy by means of a deadly weapon or dangerous ordnance as 16
defined in section 2923.11 of the Revised Code.17

       (B) No person shall cause the death of another when all of 18
the following apply:19

        (1) The person owns real property, or represents the owner of 20
real property, that has been determined to be uninhabitable by a 21
municipal, township, county, or state authority.22

        (2) The person has received notice that the property 23
described in division (B)(1) of this section has been determined 24
to be uninhabitable.25

        (3) The person knowingly permits the victim to inhabit the 26
property described in division (B)(1) of this section as the 27
victim's living quarters and in exchange for mutually agreed upon 28
consideration.29

        (4) The victim engages in an activity that a reasonable 30
person would engage in to alleviate the uninhabitable condition of 31
the property described in division (B)(1) of this section, and as 32
a proximate result of that activity the victim is killed.33

        (C) Whoever violates this section is guilty of negligent 34
homicide, a misdemeanor of the first degree.35

       Section 2. That existing section 2903.05 of the Revised Code 36
is hereby repealed.37
