A BILL
To enact section 3937.381 of the Revised Code to 1
prohibit auto insurers from requiring, 2
recommending, or suggesting that a claimant on a 3
policy have the claimant's vehicle repaired at a 4
particular repair shop or by a particular person 5
unless the claimant requests a recommendation or 6
suggestion. 7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3937.381 of the Revised Code be 8
enacted to read as follows:9

       Sec. 3937.381. No insurer shall require a claimant on an 10
automobile insurance policy to have the claimant's vehicle 11
repaired at a particular repair shop or by a particular person.12

       No insurer shall recommend or suggest that repairs of the 13
claimant's vehicle be completed at a particular repair shop or by 14
a particular person unless the claimant requests such a 15
recommendation or suggestion.16

       A violation of this section is an unfair and deceptive act or 17
practice in the business of insurance under sections 3901.19 to 18
3901.26 of the Revised Code.19
