A BILL
To enact section 1511.10 of the Revised Code to 1
prohibit a person from land applying manure under 2
specified circumstances, and to establish related 3
requirements.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1511.10 of the Revised Code be 5
enacted to read as follows:6

       Sec. 1511.10.  (A)(1) Except as provided in division (A)(2) 7
of this section, no person shall land apply manure under any of 8
the following circumstances:9

       (a) On snow-covered or frozen soil;10

       (b) When the top two inches of soil are saturated from 11
precipitation;12

        (c) When the local weather forecast for the land application 13
area contains greater than a fifty per cent chance of 14
precipitation exceeding one-half inch in a twenty-four-hour 15
period.16

       (2) A person may apply manure to snow-covered or frozen soil 17
for emergency purposes only in accordance with procedures 18
established in the United States department of agriculture natural 19
resources conservation service conservation practice standard 20
nutrient management code 590.21

       (B)(1) Beginning on the first day of December each year, a 22
person that intends to land apply manure shall ensure the 23
availability of sufficient storage for manure for at least one 24
hundred twenty days in a storage facility that is designed to 25
prevent discharges to surface and ground water.26

       (2) The person shall keep records of the volume of manure 27
stored.28

       (C) Divisions (A) and (B) of this section do not apply to 29
agricultural operations where agricultural animals are capable of 30
producing three hundred fifty tons of manure or less in a calendar 31
year. Manure produced by such an operation shall be stored away 32
from streams and highly erodible ground. The owner or operator of 33
such an agricultural operation shall keep records of the volume of 34
manure stored.35
