A BILL
To enact section 3901.711 of the Revised Code to 1
prohibit requiring an individual to obtain or 2
maintain health insurance.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3901.711 of the Revised Code be 4
enacted to read as follows:5

       Sec. 3901.711. (A)(1) No individual who is a resident of this 6
state, regardless of whether the individual has or is eligible for 7
health care coverage under any insurance policy or other program 8
provided by or through the individual's employer, or a plan 9
sponsored by this state or the federal government, shall be 10
required to obtain or maintain a policy of individual health 11
insurance, except as required by a court or government entity in a 12
judicial or administrative proceeding in which the individual is 13
named a party.14

        (2) Notwithstanding any provision of Chapter 1751. or Title 15
XXXIX of the Revised Code or any other provision of the Revised 16
Code to the contrary, no individual who is a resident of this 17
state shall be rendered liable for any penalty, assessment, fee, 18
or fine as a result of the individual's failure to obtain or 19
maintain health insurance.20

       (B) In the event that any federal, state, or local government 21
entity enacts or adopts any law, rule, or regulation that violates 22
division (A)(1) or (2) of this section, the attorney general shall 23
seek injunctive or any other appropriate relief as expeditiously 24
as possible.25

        (C) Division (A) of this section does not apply to either of 26
the following:27

       (1) An individual who voluntarily applies for coverage under 28
the medicaid program established under Chapter 5111. of the 29
Revised Code or the children's health insurance program 30
established under sections 5101.50 to 5101.529 of the Revised 31
Code;32

        (2) A student who is required by an institution of higher 33
education to obtain and maintain health insurance as a condition 34
of enrollment.35
