BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO:
WHEREAS, A project labor agreement is a pre-hire collective | 3 |
bargaining agreement between an entity and one or more labor | 4 |
organizations that establishes the terms and conditions of | 5 |
employment for a specific construction project; and | 6 |
WHEREAS, Because a project labor agreement establishes | 7 |
uniform work and pay schedules and management rights regarding | 8 |
hiring employees and includes provisions prohibiting strikes and | 9 |
other work stoppages by employees and specifying standard | 10 |
grievance procedures that are applicable to all contractors and | 11 |
unions working on a public improvement project, a project labor | 12 |
agreement is a proven way to effectively manage and maintain time | 13 |
schedules and budgets on that project and to encourage fair | 14 |
competition among contractors by standardizing labor conditions; | 15 |
and | 16 |
WHEREAS, Often public improvement projects involve multiple | 17 |
employers, which may result in project delays if the employees of | 18 |
any of those employers strike, and the lack of coordination and | 19 |
cooperation between employers may delay completion of the project; | 20 |
and | 21 |
WHEREAS, A project labor agreement reduces the costs of a | 22 |
public improvement project by allowing a state agency to know all | 23 |
of the labor costs up-front and by providing stability and | 24 |
structure to the project, since all parties are bound to the terms | 25 |
of the agreement and the project labor agreement takes precedence | 26 |
over any existing collective bargaining agreement between a union | 27 |
and a particular contractor for that project; and | 28 |
WHEREAS, In these tough economic times, a state agency should | 29 |
take any available steps to reduce the costs of projects | 30 |
undertaken by the agency; now therefore be it | 31 |
RESOLVED, That we, the members of the House of | 32 |
Representatives of the 128th General Assembly of the State of | 33 |
Ohio, encourage all state agencies to use project labor agreements | 34 |
for public improvement projects undertaken by the state agency; | 35 |
and be it further | 36 |
RESOLVED, That the Clerk of the House of Representatives | 37 |
transmit duly authenticated copies of this resolution to the | 38 |
Governor of the State of Ohio, to the heads of each state agency | 39 |
of the State of Ohio, and to the news media of Ohio. | 40 |
