A BILL
To amend section 4501.21 and to enact section 1
4503.492 of the Revised Code to create the 2
"Ovarian Cancer Awareness" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.492 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 10
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 11
4503.522, 4503.523, 4503.531, 4503.545, 4503.55, 4503.551, 12
4503.552, 4503.553, 4503.561, 4503.562, 4503.564, 4503.591, 13
4503.67, 4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 14
4503.713, 4503.72, 4503.73, 4503.74, 4503.75, 4503.751, 4503.85, 15
4503.89, 4503.92, and 4503.94 of the Revised Code. 16

       (B) The registrar shall pay the contributions the registrar 17
collects in the fund as follows: 18

        The registrar shall pay the contributions received pursuant 19
to section 4503.491 of the Revised Code to the breast cancer fund 20
of Ohio, which shall use that money only to pay for programs that 21
provide assistance and education to Ohio breast cancer patients 22
and that improve access for such patients to quality health care 23
and clinical trials and shall not use any of the money for 24
abortion information, counseling, services, or other 25
abortion-related activities. 26

       The registrar shall pay the contributions the registrar 27
receives pursuant to section 4503.492 of the Revised Code to the 28
organization cancer support community central Ohio, which shall 29
deposit the money into the Sheryl L. Kraner Fund of that 30
organization. Cancer support community central Ohio shall expend 31
the money it receives pursuant to this division only in the same 32
manner and for the same purposes as that organization expends 33
other money in that fund.34

        The registrar shall pay the contributions received pursuant 35
to section 4503.493 of the Revised Code to the autism society of 36
Ohio, which shall use the contributions for programs and autism 37
awareness efforts throughout the state. 38

       The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.494 of the Revised Code to the 40
national multiple sclerosis society for distribution in equal 41
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 42
chapters of the national multiple sclerosis society. These 43
chapters shall use the money they receive under this section to 44
assist in paying the expenses they incur in providing services 45
directly to their clients.46

       The registrar shall pay the contributions the registrar 47
receives pursuant to section 4503.496 of the Revised Code to the 48
Ohio sickle cell and health association, which shall use the 49
contributions to help support educational, clinical, and social 50
support services for adults who have sickle cell disease.51

       The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.498 of the Revised Code to 53
special olympics Ohio, inc., which shall use the contributions for 54
its programs, charitable efforts, and other activities. 55

       The registrar shall pay the contributions the registrar 56
receives pursuant to section 4503.499 of the Revised Code to the 57
children's glioma cancer foundation, which shall use the 58
contributions for its research and other programs. 59

        The registrar shall pay the contributions the registrar 60
receives pursuant to section 4503.50 of the Revised Code to the 61
future farmers of America foundation, which shall deposit the 62
contributions into its general account to be used for educational 63
and scholarship purposes of the future farmers of America 64
foundation. 65

        The registrar shall pay the contributions the registrar 66
receives pursuant to section 4503.501 of the Revised Code to the 67
4-H youth development program of the Ohio state university 68
extension program, which shall use those contributions to pay the 69
expenses it incurs in conducting its educational activities. 70

        The registrar shall pay the contributions received pursuant 71
to section 4503.502 of the Revised Code to the Ohio cattlemen's 72
foundation, which shall use those contributions for scholarships 73
and other educational activities. 74

       The registrar shall pay the contributions received pursuant 75
to section 4503.505 of the Revised Code to the organization Ohio 76
region phi theta kappa, which shall use those contributions for 77
scholarships for students who are members of that organization. 78

        The registrar shall pay each contribution the registrar 79
receives pursuant to section 4503.51 of the Revised Code to the 80
university or college whose name or marking or design appears on 81
collegiate license plates that are issued to a person under that 82
section. A university or college that receives contributions from 83
the fund shall deposit the contributions into its general 84
scholarship fund. 85

        The registrar shall pay the contributions the registrar 86
receives pursuant to section 4503.522 of the Revised Code to the 87
"friends of Perry's victory and international peace memorial, 88
incorporated," a nonprofit corporation organized under the laws of 89
this state, to assist that organization in paying the expenses it 90
incurs in sponsoring or holding charitable, educational, and 91
cultural events at the monument. 92

       The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.523 of the Revised Code to the 94
fairport lights foundation, which shall use the money to pay for 95
the restoration, maintenance, and preservation of the lighthouses 96
of fairport harbor. 97

       The registrar shall pay the contributions the registrar 98
receives pursuant to section 4503.531 of the Revised Code to the 99
thank you foundation, incorporated, a nonprofit corporation 100
organized under the laws of this state, to assist that 101
organization in paying for the charitable activities and programs 102
it sponsors in support of United States military personnel, 103
veterans, and their families.104

        The registrar shall pay the contributions the registrar 105
receives pursuant to section 4503.55 of the Revised Code to the 106
pro football hall of fame, which shall deposit the contributions 107
into a special bank account that it establishes and which shall be 108
separate and distinct from any other account the pro football hall 109
of fame maintains, to be used exclusively for the purpose of 110
promoting the pro football hall of fame as a travel destination. 111

        The registrar shall pay the contributions that are paid to 112
the registrar pursuant to section 4503.545 of the Revised Code to 113
the national rifle association foundation, which shall use the 114
money to pay the costs of the educational activities and programs 115
the foundation holds or sponsors in this state. 116

        The registrar shall pay to the Ohio pet fund the 117
contributions the registrar receives pursuant to section 4503.551 118
of the Revised Code and any other money from any other source, 119
including donations, gifts, and grants, that is designated by the 120
source to be paid to the Ohio pet fund. The Ohio pet fund shall 121
use the moneys it receives under this section to support programs 122
for the sterilization of dogs and cats and for educational 123
programs concerning the proper veterinary care of those animals, 124
and for expenses of the Ohio pet fund that are reasonably 125
necessary for it to obtain and maintain its tax-exempt status and 126
to perform its duties. 127

        The registrar shall pay the contributions the registrar 128
receives pursuant to section 4503.552 of the Revised Code to the 129
rock and roll hall of fame and museum, incorporated. 130

        The registrar shall pay the contributions the registrar 131
receives pursuant to section 4503.553 of the Revised Code to the 132
Ohio coalition for animals, incorporated, a nonprofit corporation. 133
Except as provided in division (B) of this section, the coalition 134
shall distribute the money to its members, and the members shall 135
use the money only to pay for educational, charitable, and other 136
programs of each coalition member that provide care for unwanted, 137
abused, and neglected horses. The Ohio coalition for animals may 138
use a portion of the money to pay for reasonable marketing costs 139
incurred in the design and promotion of the license plate and for 140
administrative costs incurred in the disbursement and management 141
of funds received under this section. 142

        The registrar shall pay the contributions the registrar 143
receives pursuant to section 4503.561 of the Revised Code to the 144
state of Ohio chapter of ducks unlimited, inc., which shall 145
deposit the contributions into a special bank account that it 146
establishes. The special bank account shall be separate and 147
distinct from any other account the state of Ohio chapter of ducks 148
unlimited, inc., maintains and shall be used exclusively for the 149
purpose of protecting, enhancing, restoring, and managing wetlands 150
and conserving wildlife habitat. The state of Ohio chapter of 151
ducks unlimited, inc., annually shall notify the registrar in 152
writing of the name, address, and account to which such payments 153
are to be made. 154

        The registrar shall pay the contributions the registrar 155
receives pursuant to section 4503.562 of the Revised Code to the 156
Mahoning river consortium, which shall use the money to pay the 157
expenses it incurs in restoring and maintaining the Mahoning river 158
watershed. 159

       The registrar shall pay the contributions the registrar 160
receives pursuant to section 4503.564 of the Revised Code to 161
Antioch college for the use of the Glen Helen ecology institute to 162
pay expenses related to the Glen Helen nature preserve.163

        The registrar shall pay to a sports commission created 164
pursuant to section 4503.591 of the Revised Code each contribution 165
the registrar receives under that section that an applicant pays 166
to obtain license plates that bear the logo of a professional 167
sports team located in the county of that sports commission and 168
that is participating in the license plate program pursuant to 169
division (E) of that section, irrespective of the county of 170
residence of an applicant. 171

        The registrar shall pay to a community charity each 172
contribution the registrar receives under section 4503.591 of the 173
Revised Code that an applicant pays to obtain license plates that 174
bear the logo of a professional sports team that is participating 175
in the license plate program pursuant to division (G) of that 176
section. 177

        The registrar shall pay the contributions the registrar 178
receives pursuant to section 4503.67 of the Revised Code to the 179
Dan Beard council of the boy scouts of America. The council shall 180
distribute all contributions in an equitable manner throughout the 181
state to regional councils of the boy scouts. 182

        The registrar shall pay the contributions the registrar 183
receives pursuant to section 4503.68 of the Revised Code to the 184
great river council of the girl scouts of the United States of 185
America. The council shall distribute all contributions in an 186
equitable manner throughout the state to regional councils of the 187
girl scouts. 188

        The registrar shall pay the contributions the registrar 189
receives pursuant to section 4503.69 of the Revised Code to the 190
Dan Beard council of the boy scouts of America. The council shall 191
distribute all contributions in an equitable manner throughout the 192
state to regional councils of the boy scouts. 193

       The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.701 of the Revised Code to the 195
Prince Hall grand lodge of free and accepted masons of Ohio, which 196
shall use the contributions for scholarship purposes.197

        The registrar shall pay the contributions the registrar 198
receives pursuant to section 4503.71 of the Revised Code to the 199
fraternal order of police of Ohio, incorporated, which shall 200
deposit the fees into its general account to be used for purposes 201
of the fraternal order of police of Ohio, incorporated. 202

        The registrar shall pay the contributions the registrar 203
receives pursuant to section 4503.711 of the Revised Code to the 204
fraternal order of police of Ohio, incorporated, which shall 205
deposit the contributions into an account that it creates to be 206
used for the purpose of advancing and protecting the law 207
enforcement profession, promoting improved law enforcement 208
methods, and teaching respect for law and order. 209

       The registrar shall pay the contributions received pursuant 210
to section 4503.712 of the Revised Code to Ohio concerns of police 211
survivors, which shall use those contributions to provide whatever 212
assistance may be appropriate to the families of Ohio law 213
enforcement officers who are killed in the line of duty. 214

       The registrar shall pay the contributions received pursuant 215
to section 4503.713 of the Revised Code to the greater Cleveland 216
peace officers memorial society, which shall use those 217
contributions to honor law enforcement officers who have died in 218
the line of duty and support its charitable purposes.219

       The registrar shall pay the contributions the registrar 220
receives pursuant to section 4503.72 of the Revised Code to the 221
organization known on March 31, 2003, as the Ohio CASA/GAL 222
association, a private, nonprofit corporation organized under 223
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 224
shall use these contributions to pay the expenses it incurs in 225
administering a program to secure the proper representation in the 226
courts of this state of abused, neglected, and dependent children, 227
and for the training and supervision of persons participating in 228
that program. 229

        The registrar shall pay the contributions the registrar 230
receives pursuant to section 4503.73 of the Revised Code to Wright 231
B. Flyer, incorporated, which shall deposit the contributions into 232
its general account to be used for purposes of Wright B. Flyer, 233
incorporated. 234

       The registrar shall pay the contributions the registrar 235
receives pursuant to section 4503.74 of the Revised Code to the 236
Columbus zoological park association, which shall disburse the 237
moneys to Ohio's major metropolitan zoos, as defined in section 238
4503.74 of the Revised Code, in accordance with a written 239
agreement entered into by the major metropolitan zoos. 240

       The registrar shall pay the contributions the registrar 241
receives pursuant to section 4503.75 of the Revised Code to the 242
rotary foundation, located on March 31, 2003, in Evanston, 243
Illinois, to be placed in a fund known as the permanent fund and 244
used to endow educational and humanitarian programs of the rotary 245
foundation. 246

       The registrar shall pay the contributions the registrar 247
receives pursuant to section 4503.751 of the Revised Code to the 248
Ohio association of realtors, which shall deposit the 249
contributions into a property disaster relief fund maintained 250
under the Ohio realtors charitable and education foundation.251

        The registrar shall pay the contributions the registrar 252
receives pursuant to section 4503.85 of the Revised Code to the 253
Ohio sea grant college program to be used for Lake Erie area 254
research projects. 255

       The registrar shall pay the contributions the registrar 256
receives pursuant to section 4503.89 of the Revised Code to the 257
American red cross of greater Columbus on behalf of the Ohio 258
chapters of the American red cross, which shall use the 259
contributions for disaster readiness, preparedness, and response 260
programs on a statewide basis.261

       The registrar shall pay the contributions received pursuant 262
to section 4503.92 of the Revised Code to support our troops, 263
incorporated, a national nonprofit corporation, which shall use 264
those contributions in accordance with its articles of 265
incorporation and for the benefit of servicemembers of the armed 266
forces of the United States and their families when they are in 267
financial need. 268

       The registrar shall pay the contributions the registrar 269
receives pursuant to section 4503.94 of the Revised Code to the 270
Michelle's leading star foundation, which shall use the money 271
solely to fund the rental, lease, or purchase of the simulated 272
driving curriculum of the Michelle's leading star foundation by 273
boards of education of city, exempted village, local, and joint 274
vocational school districts.275

       (C) All investment earnings of the license plate contribution 276
fund shall be credited to the fund. Not later than the first day 277
of May of every year, the registrar shall distribute to each 278
entity described in division (B) of this section the investment 279
income the fund earned the previous calendar year. The amount of 280
such a distribution paid to an entity shall be proportionate to 281
the amount of money the entity received from the fund during the 282
previous calendar year. 283

       Sec. 4503.492.  (A) The owner or lessee of any passenger car, 284
noncommercial motor vehicle, recreational vehicle, or other 285
vehicle of a class approved by the registrar of motor vehicles may 286
apply to the registrar for the registration of the vehicle and 287
issuance of ovarian cancer awareness license plates. An 288
application made under this section may be combined with a request 289
for a special reserved license plate under section 4503.40 or 290
4503.42 of the Revised Code. Upon receipt of the completed 291
application and compliance by the applicant with divisions (B) and 292
(C) of this section, the registrar shall issue to the applicant 293
the appropriate vehicle registration and a set of ovarian cancer 294
awareness license plates and a validation sticker, or a validation 295
sticker alone when required by section 4503.191 of the Revised 296
Code.297

       In addition to the letters and numbers ordinarily inscribed 298
on the license plates, ovarian cancer awareness license plates 299
shall be inscribed with identifying words or markings that promote 300
ovarian cancer awareness and are approved by the registrar. 301
Ovarian cancer awareness license plates shall display county 302
identification stickers that identify the county of registration 303
by name or number.304

       (B) Ovarian cancer awareness license plates and a validation 305
sticker, or validation sticker alone, shall be issued upon receipt 306
of a contribution as provided in division (C) of this section and 307
upon payment of the regular license tax as prescribed under 308
section 4503.04, any applicable motor vehicle license tax levied 309
under Chapter 4504. of the Revised Code, any applicable additional 310
fee prescribed by section 4503.40 or 4503.42 of the Revised Code, 311
a bureau of motor vehicles administrative fee of ten dollars, and 312
compliance with all other applicable laws relating to the 313
registration of motor vehicles.314

       (C) For each application for registration and registration 315
renewal notice the registrar receives under this section, the 316
registrar shall collect a contribution of twenty-five dollars. The 317
registrar shall transmit this contribution to the treasurer of 318
state for deposit in the license plate contribution fund created 319
in section 4501.21 of the Revised Code.320

       The registrar shall transmit the administrative fee of ten 321
dollars, the purpose of which is to compensate the bureau for the 322
additional services required in the issuing of ovarian cancer 323
awareness license plates, to the treasurer of state for deposit 324
into the state treasury to the credit of the state bureau of motor 325
vehicles fund created by section 4501.25 of the Revised Code.326

       Section 2.  That existing section 4501.21 of the Revised Code 327
is hereby repealed.328
