A BILL
To amend section 2967.14 of the Revised Code to 1
require an operator of a halfway house to notify 2
the adult parole authority within twenty-four 3
hours after a resident absconds from the halfway 4
house.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2967.14 of the Revised Code be 6
amended to read as follows:7

       Sec. 2967.14.  (A) The adult parole authority may require a8
parolee or releasee to reside in a halfway house or other suitable9
community residential center that has been licensed by the10
division of parole and community services pursuant to division (C)11
of this section during a part or for the entire period of the12
parolee's conditional release or of the releasee's term of13
post-release control. The court of common pleas that placed an14
offender under a sanction consisting of a term in a halfway house15
or in an alternative residential sanction may require the offender16
to reside in a halfway house or other suitable community17
residential center that is designated by the court and that has18
been licensed by the division pursuant to division (C) of this19
section during a part or for the entire period of the offender's20
residential sanction.21

       (B) The division of parole and community services may22
negotiate and enter into agreements with any public or private23
agency or a department or political subdivision of the state that24
operates a halfway house or community residential center that has25
been licensed by the division pursuant to division (C) of this26
section. An agreement under this division shall provide for the 27
purchase of beds, shall set limits of supervision and levels of 28
occupancy, and shall determine the scope of services for all 29
eligible offenders, including those subject to a residential 30
sanction, as defined in rules adopted by the director of31
rehabilitation and correction in accordance with Chapter 119. of 32
the Revised Code. The payments for beds and services shall be 33
equal to the halfway house's or community residential center's 34
average daily per capita costs with its facility at full 35
occupancy. The payments for beds and services shall not exceed the 36
total operating costs of the halfway house or community 37
residential center during the term of an agreement. The director 38
of rehabilitation and correction shall adopt rules in accordance 39
with Chapter 119. of the Revised Code for determining includable 40
and excludable costs and income to be used in computing the 41
agency's average daily per capita costs with its facility at full 42
occupancy.43

       The department of rehabilitation and correction may use no 44
more than ten per cent of the amount appropriated to the 45
department each fiscal year for the halfway house and community 46
residential center program to pay for contracts for nonresidential 47
services for offenders under the supervision of the adult parole 48
authority. The nonresidential services may include, but are not 49
limited to, treatment for substance abuse, mental health50
counseling, and counseling for sex offenders.51

       (C) The division of parole and community services may license 52
a halfway house or community residential center as a suitable 53
facility for the care and treatment of adult offenders, including 54
offenders sentenced under section 2929.16 or 2929.26 of the 55
Revised Code, only if the halfway house or community residential 56
center complies with the standards that the division adopts in 57
accordance with Chapter 119. of the Revised Code for the licensure 58
of halfway houses and community residential centers. The division 59
shall annually inspect each licensed halfway house and licensed60
community residential center to determine if it is in compliance61
with the licensure standards.62

       (D) The operator of a licensed halfway house shall notify the 63
adult parole authority within twenty-four hours if a resident 64
absconds from the halfway house. The adult parole authority is 65
responsible for forwarding the notice received from the halfway 66
house to the department of rehabilitation and correction within 67
twenty-four hours if the resident is under the supervision of the 68
department of rehabilitation and correction.69

       Section 2. That existing section 2967.14 of the Revised Code 70
is hereby repealed.71
