A BILL
To enact section 149.451 of the Revised Code to 1
prohibit a law enforcement agency from making 2
available to the general public on the internet a 3
motor vehicle accident report that contains a 4
minor's personal information without redacting or 5
encrypting the personal information.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 149.451 of the Revised Code be 7
enacted to read as follows:8

       Sec. 149.451.  (A) As used in this section:9

       (1) "Law enforcement agency" means an organization or unit 10
made up of law enforcement officers as defined in section 2901.01 11
of the Revised Code.12

       (2) "Minor" means a person who is less than eighteen years of 13
age.14

       (3) "Personal information" means any of the following 15
information with regard to a minor: the residential address 16
excluding the designation of the city, village, or township of 17
residence, electronic mail address, telephone number, and place of 18
employment.19

       (4) "Address" means the number of the house, apartment, or 20
other dwelling, the street name, and the postal zip code.21

       (B) If a law enforcement agency or a law enforcement officer 22
or other employee of the agency knows or should know that a motor 23
vehicle accident report contains personal information with regard 24
to a minor, the agency, officer, or employee shall not make the 25
report available to the general public on the internet without 26
redacting or encrypting the personal information pertaining to the 27
minor.28

       (C) A law enforcement agency or a law enforcement officer or 29
other employee of the agency who fails to comply with division (B) 30
of this section is entitled to immunity from liability on the same 31
grounds as those defined in division (E)(2) of section 149.45 of 32
the Revised Code.33

       (D) This section does not require a law enforcement agency, 34
or a law enforcement officer or other employee of the agency, to 35
redact or encrypt personal information from a motor vehicle 36
accident report that was made available to the general public on 37
the internet before the effective date of this section.38
