AN ACT

Relating to burial accounts.

The General Assembly of the Commonwealth of Pennsylvania

3

hereby enacts as follows:

Section 1.  Short title.

5

This act shall be known and may be cited as the Burial

6

Account Act.

7

Section 2.  Definitions.

8

The following words and phrases when used in this act shall

9

have the meanings given to them in this section unless the

10

context clearly indicates otherwise:

"Burial account."  An interest-bearing account at a bank,

12

savings and loan, credit union or other financial institution,

13

the primary purpose of which is to provide for payment, upon

14

death of the account owner, of the account owner's funeral and

15

burial expenses.

"Financial institution."  A bank, savings and loan, credit

17

union or similar financial institution.

"Funeral director."  As defined in the act of January 14,

2

1952 (1951 P.L.1898, No.522), known as the Funeral Director Law.

Section 3.  Burial account.

(a)  General rule.--All financial institutions shall permit

5

the establishment and maintenance of burial accounts in

6

accordance with the provisions of this act.

7

(b)  Expedited procedure.--Notwithstanding any other

8

provision of law, presentment by a funeral director to a

9

financial institution of an account holder's death certificate

10

along with an invoice for professional services rendered shall

11

be sufficient to authorize the release and payment of funds from

12

a burial account.

13

(c)  Limitation.--Amounts released and paid utilizing the

14

expedited payment procedure under subsection (b) shall not

15

exceed $13,000 per decedent.

16

(d)  Proof of licensure.--A funeral director shall be

17

required to provide proof of licensure in connection with a

18

claim under subsection (b).

Section 4.  Effective date.

20

This act shall take effect in 60 days.
