| AN ACT |
| |
1 | Amending the act of May 29, 1956 (1955 P.L.1804, No.600), |
2 | entitled, as amended, "An act providing for the establishment |
3 | of police pension funds or pension annuities in certain |
4 | boroughs, towns and townships; authorizing the establishment |
5 | of police pension funds or pension annuities by regional |
6 | police departments; providing for the regulation and |
7 | maintenance of police pension funds or pension annuities; |
8 | providing for an actuary; continuance of existing funds or |
9 | transfer thereof to funds herein established; prescribing |
10 | rights of beneficiaries; contributions by members; providing |
11 | for expenses of administration; continuation of existing |
12 | authority to provide annuity contracts; credit for military |
13 | service; refunds; exempting allowances from judicial process; |
14 | and repealing certain acts," providing for part-time service |
15 | credit. |
16 | The General Assembly of the Commonwealth of Pennsylvania |
17 | hereby enacts as follows: |
18 | Section 1. The act of May 29, 1956 (1955 P.L.1804, No.600), |
19 | referred to as the Municipal Police Pension Law, is amended by |
20 | adding a section to read: |
21 | Section 4.1. (a) Any member of the police force employed by |
22 | a borough, town, township or regional police department, who has |

1 | been a regularly appointed full-time employe of any such |
2 | political subdivision or regional police department for a period |
3 | of at least six months and who prior thereto was a member of |
4 | such force on a part-time basis, shall have credited to his |
5 | employment record for pension or retirement benefits all of the |
6 | time spent by him in such part-time service. |
7 | (b) The ordinance or resolution establishing the police |
8 | pension fund may provide full service credit for each year of |
9 | part-time service or fraction thereof, not to exceed five years, |
10 | to any member of the police force who was employed by the |
11 | political subdivision or regional police department during such |
12 | part-time service. The amount due for the purchase of credit for |
13 | such part-time service shall be computed by applying the average |
14 | normal cost rate for borough, town, township and regional police |
15 | pension plans as certified by the Public Employee Retirement |
16 | Commission, but not to exceed ten per centum, to the member's |
17 | average annual rate of compensation over the first three years |
18 | of municipal service and multiplying the result by the number of |
19 | years and fractional part of a year of creditable part-time |
20 | service being purchased together with interest at the rate of |
21 | four and three-quarters per centum compounded annually from the |
22 | date of initial entry into full-time municipal service to the |
23 | date of payment. |
24 | (c) Any member of the police force shall be eligible to |
25 | receive service credit for part-time service as provided in |
26 | subsections (a) and (b) provided that he is not entitled to |
27 | receive, eligible to receive now or in the future or is |
28 | receiving retirement benefits for such service under a |
29 | retirement system administered and wholly or partially paid for |
30 | by any other governmental agency. |
