| AN ACT |
| |
1 | Amending the act of June 27, 2006 (1st Sp.Sess., P.L.1873, |
2 | No.1), entitled "An act providing for taxation by school |
3 | districts, for the State funds formula, for tax relief in |
4 | first class cities, for school district choice and voter |
5 | participation, for other school district options and for a |
6 | task force on school cost reduction; making an appropriation; |
7 | prohibiting prior authorized taxation; providing for |
8 | installment payment of taxes; restricting the power of |
9 | certain school districts to levy, assess and collect taxes; |
10 | and making related repeals," further providing for adoption |
11 | of further referendum. |
12 | The General Assembly of the Commonwealth of Pennsylvania |
13 | hereby enacts as follows: |
14 | Section 1. Section 332(c) of the act of June 27, 2006 (1st |
15 | Sp.Sess., P.L.1873, No.1), known as the Taxpayer Relief Act, is |
16 | amended and the section is amended by adding a subsection to |
17 | read: |
18 | Section 332. Adoption of further referendum. |

20 | (b.1) 2011 municipal election in certain third class |
21 | counties.--A board of school directors in a county of the third |
22 | class with a city of the third class having a population between |

1 | 40,000 and 41,000 as determined by the Bureau of the United |
2 | States Census in the Department of Commerce in the 2000 Census |
3 | shall submit a referendum question pursuant to subsection (b) to |
4 | the electorate of the school district at the municipal election |
5 | of 2011. The proposed tax rate shall be established by the board |
6 | of school directors of the school district and shall equal the |
7 | rate required to provide an exclusion for homestead property and |
8 | farmstead property equal to the maximum exclusion under 53 |
9 | Pa.C.S. § 8586 (relating to limitations). Subsections (a)(2), |
10 | (d), (e), (g), (h) and (i) shall apply to a referendum question |
11 | held pursuant to this subsection. No school district shall seek |
12 | to impose a tax pursuant to this subsection that is authorized |
13 | under section 321(b). |
14 | (c) Proposed tax rate.--The proposed rate of the earned |
15 | income and net profits tax or personal income tax shall be |
16 | established by the board of school directors of the school |
17 | district and shall not exceed the rate, when combined with the |
18 | tax rate authorized under section 331.2, required to provide an |
19 | exclusion for homestead property and farmstead property equal to |
20 | the maximum exclusion under 53 Pa.C.S. § 8586 [(relating to |
21 | limitations)]. |
