| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, in enforcement, further providing for investigation |
3 | by police officers. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 6308(b) of Title 75 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 6308. Investigation by police officers. |

10 | (b) Authority of police officer.-- |
11 | (1) Whenever a police officer is engaged in a systematic |
12 | program of checking vehicles or drivers or has reasonable |
13 | suspicion that a violation of this title is occurring or has |
14 | occurred, he may stop a vehicle, upon request or signal, for |
15 | the purpose of checking the vehicle's registration, proof of |
16 | financial responsibility, vehicle identification number or |
17 | engine number or the driver's license, or to secure such |
18 | other information as the officer may reasonably believe to be |

1 | necessary to enforce the provisions of this title. |
2 | (2) Notwithstanding the provisions of paragraph (1), no |
3 | police officer who stops a vehicle in accordance with |
4 | paragraph (1) may use a data extraction device to secure |
5 | information from an electronic device in the possession of |
6 | the driver or passenger in the vehicle. |
7 | (3) For purposes of this subsection, "data extraction |
8 | device" means a tool used to extract data stored in a |
9 | telecommunications device, including, but not limited to, the |
10 | following data: call history, text messages, contacts, |
11 | images, videos, geotags, voice mails, voice recordings, |
12 | source messaging service (SMS) messages, multi-media |
13 | messaging service (MMS) messages or subscriber identification |
14 | module (SIM) data. |
