| AN ACT |
| |
1 | Providing for Pennsylvania-manufactured incandescent light |
2 | bulbs. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Pennsylvania |
7 | Incandescent Light Bulb Freedom Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "Generic and insignificant parts." Include, but are not |
13 | limited to, steel, glass, springs, screws, nuts, pins and |
14 | ceramics. |
15 | "Incandescent light bulb." A light bulb containing a |
16 | filament or filaments that produce light when the filament or |

1 | filaments are heated due to electrical resistance. |
2 | Section 3. Applicability of Federal law and regulation. |
3 | (a) General rule.--An incandescent light bulb that is |
4 | manufactured commercially or privately in this Commonwealth from |
5 | basic materials that can be manufactured without the inclusion |
6 | of any significant parts imported from another state and is |
7 | offered for sale and sold for use only within this Commonwealth |
8 | is deemed to be in the stream of intrastate commerce, rather |
9 | than interstate commerce, and is not subject to Federal law or |
10 | regulation. |
11 | (b) Generic and insignificant parts.--The incorporation of |
12 | generic and insignificant parts imported from another state in |
13 | an incandescent light bulb that is manufactured and sold in this |
14 | Commonwealth under subsection (a) which have other manufacturing |
15 | or consumer product applications does not bring an incandescent |
16 | light bulb into interstate commerce and does not subject it to |
17 | Federal law or regulation. |
18 | (c) Basic materials.--Basic materials, such as unmachined |
19 | and unshaped steel and glass, imported from another state that |
20 | are to be altered for incorporation into an incandescent light |
21 | bulb are deemed to be an insignificant part of the bulb under |
22 | subsection (b) prior to their alteration and after their |
23 | incorporation into the bulb. If these basic materials are |
24 | otherwise manufactured, offered for sale and sold in accordance |
25 | with subsection (a), they are not in interstate commerce and not |
26 | subject to Federal law or regulation under subsection (b). |
27 | Section 4. Indication of manufacture. |
28 | An incandescent light bulb manufactured, offered for sale or |
29 | sold in this Commonwealth under this act must have the words |
30 | "Made in Pennsylvania" clearly stamped, engraved or otherwise |

1 | clearly indicated on a central part of the bulb. |
2 | Section 5. Applicability. |
3 | This act applies to incandescent light bulbs that are |
4 | manufactured on or after the effective date of this act. |
5 | Section 6. Effective date. |
6 | This act shall take effect immediately. |
