| AN ACT |
| |
1 | Amending the act of December 19, 1974 (P.L.973, No.319), |
2 | entitled "An act prescribing the procedure under which an |
3 | owner may have land devoted to agricultural use, agricultural |
4 | reserve use, or forest reserve use, valued for tax purposes |
5 | at the value it has for such uses, and providing for |
6 | reassessment and certain interest payments when such land is |
7 | applied to other uses and making editorial changes," further |
8 | providing for applications for preferential assessments. |
9 | The General Assembly of the Commonwealth of Pennsylvania |
10 | hereby enacts as follows: |
11 | Section 1. Section 4 of the act of December 19, 1974 |
12 | (P.L.973, No.319), known as the Pennsylvania Farmland and Forest |
13 | Land Assessment Act of 1974, is amended by adding a subsection |
14 | to read: |
15 | Section 4. Applications for Preferential Assessments.--* * * |
16 | (b.4) (1) An application for preferential assessment shall |
17 | include a verification that the landowner has a current erosion |
18 | and sediment control plan. A landowner with an existing |
19 | preferential assessment shall submit verification that the |
20 | landowner has a current erosion and sediment control plan no |

1 | later than four years after the effective date of this |
2 | subsection. The department shall develop a verification form, |
3 | which shall require the signature of the landowner and a person |
4 | qualified to develop or review erosion and sediment control |
5 | plans. |
6 | (2) For purposes of this subsection, "erosion and sediment |
7 | control plan" means a site specific plan identifying best |
8 | management practices to minimize accelerated erosion and |
9 | sedimentation from agricultural runoff that meets the |
10 | requirements of 25 Pa. Code Ch. 102 (relating to erosion and |
11 | sediment control). |
