AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in interscholastic athletic
accountability, providing for participation by nonpublic
schools and private schools and for required divisions.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding sections
to read:
Section 1606-A. Participation by Nonpublic Schools and
Private Schools.--(a) No nonpublic school or private school
that offers scholarships or tuition assistance to students
enrolled in the nonpublic school or private school may
participate in interscholastic athletic playoffs or
championships between public schools.
(b) Nothing in this section shall be construed to prohibit a
nonpublic school or private school from participating in regular
season play of interscholastic athletics with public schools.
Section 1607-A. Required divisions.--(a) The association
shall establish two divisions within the organization as
follows:
(1) Division I, which division shall consist of public
schools and nonpublic schools and private schools that do not
offer scholarships or tuition assistance to students.
(2) Division II, which division shall consist of nonpublic
schools and private schools that offer scholarships or tuition
assistance to students.
(b) The playoffs and championships of Division I shall be
held concurrently with the playoffs and championships of
Division II.
(c) The association shall revise its policies to implement
the provisions of this section.
Section 2. Nothing in this act shall be construed to require
the Pennsylvania Interscholastic Athletic Association to revise
current classifications by enrollment and the existing
classification structure may continue to exist within the
confines of the requirements for Divisions I and II as specified
in section 1607-A of the act.
Section 3. This act shall take effect in 60 days.
