AN ACT

Amending the act of June 26, 2001 (P.L.755, No.77), entitled "An

2

act establishing a special fund and account for money

3

received by the Commonwealth from the Master Settlement

4

Agreement with tobacco manufacturers; providing for home and

5

community-based care, for tobacco use prevention and

6

cessation efforts, for Commonwealth universal research

7

enhancement, for hospital uncompensated care, for health

8

investment insurance, for medical assistance for workers with

9

disabilities, for regional biotechnology research centers,

10

for the HealthLink Program, for community-based health care

11

assistance programs, for PACE reinstatement and PACENET

12

expansion, for medical education loan assistance and for

13

percentage allocation and appropriation of moneys," further

14

providing for use of Tobacco Settlement Fund; and

15

establishing the Cigarette Home Safety Firefighters

16

Scholarship Fund.

The General Assembly of the Commonwealth of Pennsylvania

18

hereby enacts as follows:

19

Section 1.  Section 306(b) of the act of June 26, 2001

20

(P.L.755, No.77), known as the Tobacco Settlement Act, is

21

amended to read:

(b)  Appropriations.--

2

(1)  The General Assembly hereby appropriates funds in

3

the fund in accordance with the following percentages based

4

on actual funds received in each year or upon receipt of the

5

final annual payment:

6

(i)  Eight percent for deposit into the Health

7

Account pursuant to this chapter, which shall be

8

deposited immediately upon receipt.

9

(ii)  Thirteen percent for home and community-based

10

services pursuant to Chapter 5. For fiscal year

11

2001-2002, up to $13.5 million may be used for expanded

12

counseling, area agency on aging training and education,

13

assistive technology and for reducing waiting lists for

14

services in the Department of Aging.

15

(iii)  Twelve percent for tobacco use prevention and

16

cessation programs pursuant to Chapter 7.

17

(iv)  [Eighteen] Seventeen percent for health and

18

related research pursuant to section 906 and one percent

19

for health and related research pursuant to section 909.

20

(v)  Ten percent for the uncompensated care payment

21

program pursuant to Chapter 11.

22

(vi)  Thirty percent for health investment insurance

23

pursuant to Chapter 13 and for the purchase of Medicaid

24

benefits for workers with disabilities pursuant to

25

Chapter 15.

26

(vii)  Eight percent for the expansion of the PACENET

27

program pursuant to Chapter 23.

28

(viii)  One percent to be deposited in the State

29

Treasury in the Cigarette Home Safety Firefighters

30

Scholarship Fund pursuant to section 2604.

(2)  In addition, any Federal funds received for any of

2

these programs is hereby specifically appropriated to those

3

programs.

Section 2.  The act is amended by adding a chapter to read:

CHAPTER 26

CIGARETTE HOME SAFETY FIREFIGHTERS SCHOLARSHIP FUND

8

Section 2601.  Scope

9

This chapter deals with the establishment of the Cigarette

10

Home Safety Firefighters Scholarship Fund and disbursement of

11

funds for eligible applicants.

12

Section 2602.  Declaration of intent.

13

The General Assembly declares as follows:

14

(1)  According to the United States Consumer Product

15

Safety Commission, cigarettes provide a significant risk of

16

fire to homeowners, with smoldering fires in mattresses and

17

bedding being a significant cause of death in residential

18

fires. According to a 2006 USA Today article, cigarette fires

19

still kill 700 to 900 people annually. Despite the recent

20

mandate of fire-safe cigarettes in Pennsylvania, cigarettes

21

still pose a dangerous risk to homeowners. When fires do

22

occur, that risk and danger is then passed on to our brave

23

firefighters who risk their own lives for the purpose of

24

saving people and their homes.

(2)  Recognizing the danger of cigarette-caused home

26

fires and the bravery of our firefighters who risk their

27

lives for the purpose of saving others and their property,

28

the General Assembly deems it appropriate to establish a

29

scholarship fund for our firefighters.

Section 2603.  Definitions.

The following words and phrases when used in this chapter

2

shall have the meanings given to them in this section unless the

3

context clearly indicates otherwise:

4

"Agency."  The Pennsylvania Higher Education Assistance

5

Agency.

6

"Eligible applicant."  An individual who at the time of

7

application is an actively serving member of a volunteer or paid

8

firefighting company or service in this Commonwealth.

9

"Eligible learning institution."  An accredited postsecondary

10

institution of higher education as recognized by the

11

Pennsylvania Department of Education or postsecondary vocational

12

school.

13

"Fund."  The Cigarette Home Safety Firefighters Scholarship

14

Fund established in section 2604.

Section 2604.  Cigarette Home Safety Firefighters Scholarship

16

Fund

(a)  Establishment.--A fund is hereby established in the

18

State Treasury to be used solely for scholarships for eligible

19

applicants except as provided in subsection (e). The

20

scholarships shall be administered through the agency which will

21

make the necessary requests for withdrawal of moneys from the

22

fund.

(b)  Scholarship description.--An eligible applicant may

24

apply with the agency for a one-time scholarship in the amount

25

of $4,000 to be used in an eligible learning institution.

26

(c)  Eligibility.--An eligible applicant must be enrolled in

27

an eligible learning institution at the time of application or

28

up to six months prior to enrolling in an eligible learning

29

institution.

(d)  Agency duties.--The agency shall:

(1)  Administer the program and award scholarships from

the fund by establishing procedures and providing forms as

3

may be necessary to implement the program. A scholarship to

4

an eligible applicant under the program shall not exceed

5

$4,000.

(2)  Ensure that funds are used in accordance with

7

program requirements. Scholarship recipients shall provide

8

information relating to the expenditure of money in the

9

format specified by the agency.

10

(e)  Remaining money.--At the end of each fiscal year,

11

remaining money in the fund shall be deposited into the General

12

Fund.

13

Section 3.  This act shall take effect in 60 days.
