| AN ACT |
| |
1 | Prohibiting disbursement of State funding and other activities |
2 | relating to certain covered organizations. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Short title. |
6 | This act shall be known and may be cited as the Denial of |
7 | State Funding to Covered Organizations Act. |
8 | Section 2. Definitions. |
9 | The following words and phrases when used in this act shall |
10 | have the meanings given to them in this section unless the |
11 | context clearly indicates otherwise: |
12 | "ACORN." The Association of Community Organizations for |
13 | Reform Now. |
14 | "ACORN affiliate." Any of the following entities: |
15 | (1) A State chapter of ACORN that is registered with the |
16 | Secretary of State of the Commonwealth. |

1 | (2) An organization that shares a director, employee or |
2 | independent contractor with ACORN. |
3 | (3) An organization whose finances, whether federally |
4 | funded, donor-funded or raised through organizational goods |
5 | and services, are shared or controlled by ACORN. |
6 | "Applicable individual." An individual who has been indicted |
7 | for a violation of Federal or State law relating to the election |
8 | of a person to a public office of the Federal or State |
9 | government. |
10 | "Commonwealth agency." As defined in 62 Pa.C.S. § 103 |
11 | (relating to definitions). |
12 | "Covered organization." An organization that: |
13 | (1) Has been indicted for a violation under any State |
14 | law governing the financing of a campaign for election for |
15 | public office or any law governing the administration of an |
16 | election for public office, including a law relating to voter |
17 | registration. |
18 | (2) Has had its State corporate charter terminated due |
19 | to its failure to comply with State lobbying disclosure |
20 | requirements. |
21 | (3) Has filed a fraudulent form with any State |
22 | regulatory agency. |
23 | (4) Has engaged in any of the following conduct: |
24 | (i) employed an applicable individual in a permanent |
25 | or temporary capacity; |
26 | (ii) entered into a contract with or retains an |
27 | applicable individual; or |
28 | (iii) requested an applicable individual to act on |
29 | the organization's behalf or with the express or apparent |
30 | authority of the organization. |

1 | The term includes ACORN and any ACORN affiliate. |
2 | "Political activity." The term includes all of the following |
3 | activities: |
4 | (1) Taking an active role in political management or in |
5 | a political campaign. |
6 | (2) Organizing a political party, organization or |
7 | political club. |
8 | (3) Directly or indirectly soliciting, receiving, |
9 | collecting, handling, disbursing or accounting for |
10 | assessments, contributions or other funds for a partisan |
11 | political purpose. |
12 | (4) Organizing, selling tickets to, promoting or |
13 | actively participating in a fundraising activity of a |
14 | candidate in a partisan election or of a political party or |
15 | political club. |
16 | (5) Taking an active part in managing the political |
17 | campaign of a candidate for public office in a partisan |
18 | election or a candidate for political party office. |
19 | (6) Soliciting votes in support of or in opposition to a |
20 | candidate for public office in a partisan election or a |
21 | candidate for political party office. |
22 | (7) Organizing individuals to act as recorders, |
23 | watchers, challengers or similar officers at the polls on |
24 | behalf of a political party or a candidate or in a partisan |
25 | election. |
26 | (8) Driving voters to the polls on behalf of a political |
27 | party or a candidate in a partisan election or organizing |
28 | individuals to drive voters to the polls on behalf of a |
29 | political party or a candidate in a partisan election. |
30 | (9) Endorsing or opposing a candidate for public office |

1 | in a partisan election or a candidate for political party |
2 | office in a political advertisement, broadcast, literature or |
3 | similar material. |
4 | (10) Addressing a convention, caucus, rally or similar |
5 | gathering of a political party in support of or in opposition |
6 | to a partisan candidate for political office or political |
7 | party office. |
8 | (11) Initiating or circulating a partisan nominating |
9 | petition. |
10 | (12) Soliciting, paying, collecting or receiving a |
11 | contribution from any employee or volunteer for any political |
12 | party, political fund or other partisan recipient. |
13 | (13) Organizing a voter registration drive on behalf of |
14 | a political party or a candidate in a partisan election. |
15 | "State funds." Any funds in the State Treasury or under the |
16 | care, custody or control of the State Treasurer or any |
17 | Commonwealth agency in accordance with law. |
18 | Section 3. Prohibitions. |
19 | (a) Funding.--Notwithstanding any other provision of law, no |
20 | State funds may be disbursed to or expended on a covered |
21 | organization that engages in political activity, either directly |
22 | or indirectly, through its officers or directors on behalf of |
23 | the entity. |
24 | (b) Contracts and grants.--No Commonwealth agency shall |
25 | approve or enter into a State contract, grant, cooperative |
26 | agreement or any other form of agreement, including, but not |
27 | limited to, a memorandum of understanding, with a covered |
28 | organization. |
29 | (c) Employees and contractors.--No employee or contractor of |
30 | a Commonwealth agency may promote in any way, including |

1 | recommending to a person or referring to a person for any |
2 | purpose, a covered organization. |
3 | Section 4. Effective date. |
4 | This act shall take effect in 60 days. |
