| AN ACT |
| |
1 | Amending Title 75 (Vehicles) of the Pennsylvania Consolidated |
2 | Statutes, further providing for operation following |
3 | suspension of registration. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 1371 of Title 75 of the Pennsylvania |
7 | Consolidated Statutes is amended to read: |
8 | § 1371. Operation following suspension of registration. |
9 | (a) General rule.--No person shall operate and no owner |
10 | shall permit to be operated upon any highway a vehicle the |
11 | registration of which has been suspended. |
12 | (a.1) Impound of vehicle.--When an officer has probable |
13 | cause to believe a person has violated subsection (a), the |
14 | officer shall not permit the suspected offender to drive the |
15 | involved vehicle. The officer may permit the registered owner to |
16 | remove the vehicle from the place of the traffic stop so long as |
17 | the registered owner is properly licensed to drive the vehicle |

1 | and the officer does not have probable cause to issue a citation |
2 | to the registered owner for a violation of subsection (a) or |
3 | section 1575 (relating to permitting violation of title). |
4 | Otherwise, the officer shall impound the vehicle. |
5 | (a.2) Forfeiture of vehicle.--Any motor vehicle used in |
6 | violation of this section shall be forfeited to the Commonwealth |
7 | if, upon hearing, the Commonwealth shows by a preponderance of |
8 | the evidence that the registered owner operated the vehicle in |
9 | violation of this section. |
10 | (b) Penalty.--[Any] Notwithstanding the provisions of |
11 | subsections (a.1) and (a.2), any person violating this section |
12 | is guilty of a summary offense and shall, upon conviction, be |
13 | sentenced to pay a fine of not less than $100 nor more than |
14 | $500. In the case of a motor carrier vehicle other than a |
15 | trailer, the fine shall be double the registration fee for the |
16 | maximum weight at which the vehicle could have been registered |
17 | in this Commonwealth. |
18 | Section 2. This act shall take effect in 60 days. |
