| AN ACT |
| |
1 | Amending Title 34 (Game) of the Pennsylvania Consolidated |
2 | Statutes, further providing for regulated hunting grounds |
3 | permits. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Section 2928(a), (f), (g) and (h) of Title 34 of |
7 | the Pennsylvania Consolidated Statutes are amended to read: |
8 | § 2928. Regulated hunting grounds permits. |
9 | (a) Eligibility.--Regulated hunting grounds require a |
10 | minimum of 100 acres of land, or land and water combined, on |
11 | which the permittee must release one of the following species of |
12 | domestically produced game birds: namely, ringneck pheasants, |
13 | bobwhite quail or mallard ducks. Any of the listed species and |
14 | chukar partridges may be released only if they are listed on the |
15 | permit application and propagated by the permittee or received |
16 | from a legal source.[At least 100 of each species listed on the |
17 | permit shall be released.] |

1 | (f) Tagging killed birds.--[Before] Except for chukar |
2 | partridges, before any released bird killed under the provisions |
3 | of a regulated hunting grounds permit is consumed on the |
4 | premises or removed from the premises, the permittee shall |
5 | attach a tag to one leg of each bird killed. The tags shall be |
6 | numbered consecutively and supplied by the commission at |
7 | reasonable cost and shall contain such information as the |
8 | commission may require. [No game bird killed on a regulated |
9 | hunting ground shall have the right foot removed until a |
10 | regulated hunting ground tag for the current season is attached |
11 | to the bird.] The tags shall remain attached to the individual |
12 | birds until prepared for consumption and shall not be used more |
13 | than once. |
14 | (g) Dog training and trials.--Dogs may be trained or field |
15 | trials may be held at any time of the year upon the premises |
16 | covered by a regulated hunting grounds permit, and retriever |
17 | trials may be conducted thereon. All game birds killed shall be |
18 | included in the reported kill. Except during the open season for |
19 | shooting, no game birds or chukar partridges shall be killed |
20 | while training dogs or conducting field trials on commercial |
21 | regulated hunting grounds. The special permit required in this |
22 | title shall first be obtained to conduct a retriever trial |
23 | thereon at any other period. |
24 | (h) Unlawful acts.--It is unlawful to: |
25 | (1) Remove from or consume on the premises covered by a |
26 | regulated hunting grounds permit pheasants, bobwhite quail or |
27 | mallard ducks killed in accordance with the provisions of |
28 | this section which have not been tagged as required by this |
29 | section. |
30 | (2) Violate any of the provisions of this chapter |

1 | regarding marking and tagging of birds. |
2 | (3) Use any methods to hunt for, chase or kill birds on |
3 | a regulated hunting ground which are not specifically |
4 | permitted by this title. |
5 | (4) Trap any game bird or have any trap set that is |
6 | capable of taking a game bird alive on any regulated hunting |
7 | grounds unless authorized by this title. |
8 | [(5) Hunt for or take any game on a three-day hunting |
9 | license other than permitted by subsection (d).] |
10 | (6) Violate any of the other provisions of this section. |
