Amending the act of November 10, 1999 (P.L.491, No.45), entitled

"An act establishing a uniform construction code; imposing

3

powers and duties on municipalities and the Department of

4

Labor and Industry; providing for enforcement; imposing

5

penalties; and making repeals," further providing for

6

administration and enforcement.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 501(c) of the act of November 10, 1999

10

(P.L.491, No.45), known as the Pennsylvania Construction Code

11

Act, is amended by adding paragraphs to read:

Section 501.  Administration and enforcement.

(c)  Board of appeals.--

(6)  Municipalities which do not have a board of appeals

17

as required under paragraph (1) shall be subject to a fine

18

imposed by the department of $100 per day after January 1,

19

2010.

(7)  The department shall investigate complaints about

2

violations of paragraph (4) and may order a reimbursement of

3

fees to affected parties, and may impose a fine of up to

4

$10,000 on the appropriate municipality or municipalities.

Section 2.  This act shall take effect in 60 days.
