| AN ACT |
| |
1 | Providing for the capital budget for the fiscal year 2010-2011; | <-- |
2 | itemizing public improvement projects, transportation |
3 | assistance projects and redevelopment assistance capital |
4 | projects to be constructed or acquired or assisted by the |
5 | Department of General Services, the Department of Community |
6 | and Economic Development and the Department of |
7 | Transportation, together with their estimated financial |
8 | costs; authorizing the incurring of debt without the approval |
9 | of the electors for the purpose of financing the projects to |
10 | be constructed, acquired or assisted by the Department of |
11 | General Services, the Department of Community and Economic |
12 | Development or the Department of Transportation; stating the |
13 | estimated useful life of the projects; providing an |
14 | exemption; providing for limitation on certain capital |
15 | projects and for delegation of duties relating to a capital |
16 | budget project to the University of Pennsylvania; and making |
17 | appropriations. |
18 | The General Assembly of the Commonwealth of Pennsylvania |
19 | hereby enacts as follows: |
20 | Section 1. Short title and construction. |
21 | (a) Short title.--This act shall be known and may be cited |
22 | as the Capital Budget and Project Itemization Act of 2010-2011. | <-- |
23 | (b) Supplements.--A reference to this act shall be deemed to |
24 | include a reference to the supplements to this act. |
25 | (c) Capital Facilities Debt Enabling Act.--The provisions |
|
1 | and definitions of Chapter 3 of the act of February 9, 1999 |
2 | (P.L.1, No.1), known as The Capital Facilities Debt Enabling |
3 | Act, shall apply to this act to the extent they are not |
4 | inconsistent with this act. |
5 | Section 2. Overall limitations on debt to be incurred for |
6 | capital projects. |
7 | The maximum principal amount of additional debt to be |
8 | incurred during the 2010-2011 fiscal year, and thereafter until |
9 | the enactment of the 2011-2012 capital budget specifying the |
10 | maximum debt for the 2011-2012 fiscal year, for capital projects |
11 | specifically itemized in a capital budget pursuant to section |
12 | 7(a)(4) of Article VIII of the Constitution of Pennsylvania, and |
13 | the fund to be charged with the repayment of such debt, shall, |
14 | with respect to each category of capital projects, be as |
15 | follows: |

8 | This act shall take effect July 1, 2010, or immediately, |
9 | whichever is later. |
10 | Section 3. Total authorizations. | <-- |
11 | (a) Public improvements.--The total authorization for the |
12 | additional capital projects in the category of public |
13 | improvement projects itemized in section 4 and to be acquired or |
14 | constructed by the Department of General Services, its |
15 | successors or assigns, and to be financed by the incurring of |
16 | debt, shall be $28,060,000. |
17 | (b) Transportation assistance.--The total authorization for |
18 | the capital projects in the category of transportation |
19 | assistance projects itemized in section 5 with respect to which |
20 | an interest is to be acquired in or constructed by the |
21 | Department of Transportation, its successors or assigns, and to |
22 | be financed by the incurring of debt, shall be $9,559,000. |
23 | (c) Redevelopment assistance.--The total authorization for |
24 | the additional capital projects in the category of redevelopment |
25 | assistance capital projects itemized in section 6 for capital |
26 | grants by the Department of Community and Economic Development, |
27 | its successors or assigns, and to be financed by the incurring |
28 | of debt, shall be $298,250,000. |

26 | (a) Public improvements.--The Governor, Auditor General and |
27 | State Treasurer are hereby authorized and directed to borrow |
28 | from time to time in addition to any authorization heretofore or |
29 | hereafter enacted, on the credit of the Commonwealth, subject to |
30 | the limitations provided in the current capital budget, money |

1 | not exceeding in the aggregate the sum of $28,060,000 as may be |
2 | found necessary to carry out the acquisition and construction of |
3 | the public improvement projects specifically itemized in a |
4 | capital budget. |
5 | (b) Transportation assistance.--The Governor, Auditor |
6 | General and State Treasurer are hereby authorized and directed |
7 | to borrow from time to time in addition to any authorization |
8 | heretofore or hereafter enacted, on the credit of the |
9 | Commonwealth, subject to the limitations provided in the current |

12 | acquisition and construction of the transportation assistance |
13 | projects specifically itemized in a capital budget. |
14 | (c) Redevelopment assistance.--Subject to the limitation in |
15 | section 317(b) of the act of February 9, 1999 (P.L.1, No.1), |
16 | known as the Capital Facilities Debt Enabling Act, the Governor, |
17 | Auditor General and State Treasurer are hereby authorized and |
18 | directed to borrow from time to time in addition to any |
19 | authorization heretofore or hereafter enacted, on the credit of |
20 | the Commonwealth, subject to the limitations provided in the |
21 | current capital budget, money not exceeding in the aggregate the |
22 | sum of $298,250,000 as may be found necessary to carry out the |
23 | redevelopment assistance capital projects specifically itemized |
24 | in a capital budget. |
25 | Section 8. Issue of bonds. |
26 | The indebtedness authorized in this act shall be incurred |
27 | from time to time and shall be evidenced by one or more series |
28 | of general obligation bonds of the Commonwealth in such |
29 | aggregate principal amount for each series as the Governor, the |
30 | Auditor General and the State Treasurer shall determine, but the |

1 | latest stated maturity date shall not exceed the estimated |
2 | useful life of the projects being financed as stated in section |
3 | 9. |
4 | Section 9. Estimated useful life and term of debt. |
5 | (a) Estimated useful life.--The General Assembly states that |
6 | the estimated useful life of the public improvement projects |
7 | itemized in this act is as follows: |
8 | (1) Public improvement projects, 30 years. |
9 | (2) Transportation assistance projects: |
10 | (i) Rolling stock, 15 years. |
11 | (ii) Passenger buses, 12 years. |
12 | (iii) Furniture and equipment, 10 years. |
13 | (iv) All others, 30 years. |
14 | (b) Term of debt.--The maximum term of the debt authorized |
15 | to be incurred under this act is 30 years. |
16 | Section 10. Appropriations. |
17 | (a) Public improvements.--The net proceeds of the sale of |
18 | the obligations authorized in this act are hereby appropriated |
19 | from the Capital Facilities Fund to the Department of General |
20 | Services in the maximum amount of $28,060,000 to be used by it |
21 | exclusively to defray the financial cost of the public |
22 | improvement projects specifically itemized in a capital budget. |
23 | After reserving or paying the expenses of the sale of the |
24 | obligation, the State Treasurer shall pay to the Department of |
25 | General Services the moneys as required and certified by it to |
26 | be legally due and payable. |
27 | (b) Transportation assistance.--The net proceeds of the sale |
28 | of the obligations authorized in this act are hereby |
29 | appropriated from the Capital Facilities Fund to the Department |
30 | of Transportation in the maximum amount of $9,559,000 to be used |

1 | by it exclusively to defray the financial cost of the |
2 | transportation assistance projects specifically itemized in a |
3 | capital budget. After reserving or paying the expenses of the |
4 | sale of the obligation, the State Treasurer shall pay to the |
5 | Department of Transportation the moneys as required and |
6 | certified by it to be legally due and payable. |
7 | (c) Redevelopment assistance.--The net proceeds of the sale |
8 | of the obligations authorized in this act are hereby |
9 | appropriated from the Capital Facilities Fund to the Department |
10 | of Community and Economic Development in the maximum amount of |
11 | $298,250,000 to be used by it exclusively to defray the |
12 | financial cost of redevelopment assistance capital projects |
13 | specifically itemized in a capital budget. After reserving or |
14 | paying the expenses of the sale of the obligation, the State |
15 | Treasurer shall pay to the Department of Community and Economic |
16 | Development the moneys as required and certified by it to be |
17 | legally due and payable. |
18 | Section 11. Federal funds. |
19 | In addition to those funds appropriated in section 10, all |
20 | moneys received from the Federal Government for the projects |
21 | specifically itemized in this act are also hereby appropriated |
22 | for those projects. |
23 | Section 12. Delegation. |
24 | Notwithstanding any provision of law to the contrary, the |
25 | Department of General Services may delegate the design and |
26 | construction of the project contained in section 3(5)(iii)(A) of |
27 | the act of July 4, 2008 (P.L.329, No.41), known as the Capital |
28 | Budget Project Itemization Act of 2007-2008, to the University |
29 | of Pennsylvania. |
30 | Section 13. Editorial changes. |

1 | In editing and preparing this act for printing following the |
2 | final enactment, the Legislative Reference Bureau shall insert |
3 | or revise letters or numbers for projects where the letters or |
4 | numbers are missing or require revision. The bureau shall also |
5 | revise the total monetary amounts for the total authorization, |
6 | debt authorization, appropriations and departmental totals as |
7 | necessary to agree with the total monetary amounts of the |
8 | projects. |
9 | Section 14. Effective date. |
10 | This act shall take effect immediately. |
