AN ACT

Amending Titles 18 (Crimes and Offenses) and 23 (Domestic

2

Relations) of the Pennsylvania Consolidated Statutes, in

3

criminal history record information, further providing for

4

general regulations; and, in child protective services,

5

further providing for information relating to prospective

6

child-care personnel.

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

Section 1.  Section 9121(b)(1) of Title 18 of the

10

Pennsylvania Consolidated Statutes is amended to read:

11

§ 9121.  General regulations.

(b)  Dissemination to noncriminal justice agencies and

14

individuals.--Criminal history record information shall be

15

disseminated by a State or local police department to any

16

individual or noncriminal justice agency only upon request.

17

Except as provided in subsection (b.1):

18

(1)  A fee may be charged by a State or local police

19

department for each request for criminal history record

20

information by an individual or noncriminal justice agency,

except that no fee shall be charged to an individual who

2

makes the request in order to apply to become a volunteer

3

with an affiliate of Big Brothers of America or Big Sisters

4

of America [or], with a rape crisis center or domestic

5

violence program or with a not-for-profit corporation or

6

organization.

Section 2.  Section 6344(h) of Title 23 is amended to read:

§ 6344.  Information relating to prospective child-care

10

personnel.

(h)  Fees.--The department may charge a fee not to exceed $10

13

in order to conduct the certification as required in subsection

14

(b)(2), except that no fee shall be charged to an individual who

15

makes the request in order to apply to become a volunteer with

16

an affiliate of Big Brothers of America or Big Sisters of

17

America [or], with a rape crisis center or domestic violence

18

shelter or with a not-for-profit corporation or organization.

Section 3.  This act shall take effect in 60 days.
