AN ACT

Amending Title 65 (Public Officers) of the Pennsylvania

2

Consolidated Statutes, further providing for penalties.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1. Section 1109 of Title 65 (Public Officers) of the

6

Pennsylvania Consolidated Statutes is amended by adding a

7

subsection to read:

§ 1109.  Penalties.

9

(h)  Attorney fees.--If the court finds that the

11

investigation conducted by the State Ethics Commission was of a

12

frivolous nature or was brought with no substantial

13

justification, the court shall award the prevailing party

14

reasonable attorney fees and costs of litigation or an

15

appropriate portion of the fees and costs. If the court

16

determines that a person willfully or with wanton disregard

violated a provision of this chapter, in whole or in part, the

2

court shall award the prevailing party reasonable attorney fees

3

and costs of litigation or an appropriate portion of the fees

4

and costs.

5

Section 2.  This act shall take effect in 60 days.
