| AN ACT |
| |
1 | Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An |
2 | act relating to tax reform and State taxation by codifying |
3 | and enumerating certain subjects of taxation and imposing |
4 | taxes thereon; providing procedures for the payment, |
5 | collection, administration and enforcement thereof; providing |
6 | for tax credits in certain cases; conferring powers and |
7 | imposing duties upon the Department of Revenue, certain |
8 | employers, fiduciaries, individuals, persons, corporations |
9 | and other entities; prescribing crimes, offenses and |
10 | penalties," providing for notice of application for tax |
11 | credit. |
12 | The General Assembly of the Commonwealth of Pennsylvania |
13 | hereby enacts as follows: |
14 | Section 1. The act of March 4, 1971 (P.L.6, No.2), known as |
15 | the Tax Reform Code of 1971, is amended by adding a section to |
16 | read: |
17 | Section 3003.22. Notice of Application for Tax Credit.--(a) |
18 | Prior to applying for a tax credit in a first or second class |
19 | city, a business entity shall provide notice to the following |
20 | officials elected on behalf of the city's constituents: |
21 | (1) State Representative in whose district the qualifying |
22 | activity occurred or is to occur. |

1 | (2) State Senator in whose district the qualifying activity |
2 | occurred or is to occur. |
3 | (3) Mayor. |
4 | (4) Council member in whose district the qualifying activity |
5 | occurred or is to occur. |
6 | (b) Prior to applying for a tax credit in any other |
7 | municipality, a business entity shall provide notice to the |
8 | following officials elected on behalf of the municipality's |
9 | constituents: |
10 | (1) State Representative in whose district the qualifying |
11 | activity occurred or is to occur. |
12 | (2) State Senator in whose district the qualifying activity |
13 | occurred or is to occur. |
14 | (3) Municipal executive, including, but not limited to, a |
15 | mayor or township manager. |
16 | (4) Municipal legislative body, including, but not limited |
17 | to, a city council or township supervisors. |
18 | (c) A State Representative or State Senator under this |
19 | section may call for a public informational meeting regarding |
20 | the tax credit application. Any expenses for the public |
21 | informational meeting shall be paid by the business entity. |
22 | Notice of the public informational meeting shall be published in |
23 | the Pennsylvania Bulletin. |
24 | (d) An official or a majority of a municipal legislative |
25 | body under this section shall notify the Department of Revenue |
26 | in writing of its reasons if either objects to the tax credit. |
27 | Within a reasonable time after receiving the objection, the |
28 | department shall notify the applicant that the tax credit is |
29 | disallowed. The notice shall be sent to the business entity's |
30 | place of business located in the first or second class city or |

1 | other municipality and shall include the stated reasons for the |
2 | objection. |
3 | (e) As used in this section, the term "business entity" |
4 | means a corporation, partnership, association, limited liability |
5 | company or limited liability partnership authorized to do |
6 | business in this Commonwealth. |
7 | Section 2. This act shall take effect in 60 days. |
