| AN ACT |
| |
1 | Amending the act of July 9, 1987 (P.L.220, No.39), entitled "An |
2 | act licensing and regulating the practice of social work; |
3 | providing penalties; and making an appropriation," further |
4 | providing for legislative intent, for definitions, for |
5 | licensure, for the licensing agency and its functions, for |
6 | licensure qualifications and procedure, for exemptions, for |
7 | reciprocity and for license reinstatement; providing for |
8 | restrictions on use of title "Licensed Human Services |
9 | Professional"; and further proscribing unlawful practice. |
10 | The General Assembly of the Commonwealth of Pennsylvania |
11 | hereby enacts as follows: |
12 | Section 1. Section 2 of the act of July 9, 1987 (P.L.220, |
13 | No.39), known as the Social Workers, Marriage and Family |
14 | Therapists and Professional Counselors Act, amended December 21, |
15 | 1998 (P.L.1017, No.136), is amended to read: |
16 | Section 2. Legislative intent. |
17 | The practice of social work, marriage and family therapy |
18 | [and], professional counseling and human services within this |
19 | Commonwealth is hereby declared to affect the public safety and |
20 | welfare and to be subject to regulation and control in the |
|
1 | public interest to protect the public from unprofessional, |
2 | improper, unauthorized and unqualified practice of licensed |
3 | social work, licensed marriage and family therapy [and], |
4 | licensed professional counseling and licensed human services |
5 | work. This act regulates only those who hold themselves out as |
6 | licensed social workers, licensed clinical social workers, |
7 | licensed marriage and family therapists [or as], licensed |
8 | professional counselors or as licensed human services |
9 | professionals. [Acquisition of a license under this act shall |
10 | not be made a condition of the employment of a person by the |
11 | Commonwealth or any of its political subdivisions or by |
12 | nonprofit agencies.] |
13 | Section 2. Section 3 of the act is amended by adding |
14 | definitions to read: |
15 | Section 3. Definitions. |
16 | The following words and phrases when used in this act shall |
17 | have the meanings given to them in this section unless the |
18 | context clearly indicates otherwise: |

20 | "Licensed human services professional." A human services |
21 | professional who holds a current license under this act. |
22 | * * * |
23 | "Practice of licensed human services." Holding oneself out |
24 | to the public by any title or description of services |
25 | incorporating the term "licensed human services professional," |
26 | or using any words or symbols indicating or tending to indicate |
27 | that the individual is a licensed human services professional |
28 | and, under such description, offering to render or rendering a |
29 | service under the supervision of an agency in which the |
30 | application of interdisciplinary theory, knowledge and methods |

1 | is designed to improve, restore or enhance the social or |
2 | psychosocial functioning of individuals, couples, families or |
3 | groups through the provision of services, excluding those of a |
4 | clinical nature, such as clinical assessment, treatment plan |
5 | development, counseling or psychotherapy. Appropriate licensed |
6 | human services include investigation of abuse, crisis response, |
7 | resource referral, visitation supervision, care and custody |
8 | within a program or facility, assessment of client needs for |
9 | nonclinical community programs or services, implementation of |
10 | plans for the delivery of community services based on client |
11 | needs, advocacy on behalf of persons or groups with unmet |
12 | service needs and provision of training about community needs |
13 | and problems. |

15 | "Provisionally licensed human services professional." A |
16 | human services professional who holds a current provisional |
17 | license under this act. |

19 | Section 3. Section 4 of the act, amended December 21, 1998 |
20 | (P.L.1017, No.136), is amended to read: |
21 | Section 4. License required. |
22 | It shall be unlawful for any person to hold himself or |
23 | herself forth as a licensed social worker, licensed clinical |
24 | social worker, licensed marriage and family therapist [or], |
25 | licensed professional counselor, licensed human services |
26 | professional or provisionally licensed human services |
27 | professional unless he or she shall first have obtained a |
28 | license pursuant to this act. |
29 | Section 4. Section 5(a) and (l) of the act, amended December |
30 | 21, 1998 (P.L.1017, No.136), are amended and the section is |

1 | amended by adding a subsection to read: |
2 | Section 5. State Board of Social Workers, Marriage and Family |
3 | Therapists and Professional Counselors. |
4 | (a) Creation.--There is hereby created the State Board of |
5 | Social Workers, Marriage and Family Therapists and Professional |
6 | Counselors, a departmental administrative board in the |
7 | Department of State. The board shall consist of [13] 15 members |
8 | who are citizens of the United States and who have been |
9 | residents of this Commonwealth for a two-year period, two of |
10 | whom shall be public members; five of whom shall be licensed |
11 | social workers, at least one of whom shall be a licensed |
12 | clinical social worker and at least one of whom shall be a |
13 | licensed social worker; two of whom shall be licensed marriage |
14 | and family therapists; two of whom shall be licensed |
15 | professional counselors; one of whom shall be either a licensed |
16 | marriage and family therapist or a licensed professional |
17 | counselor as hereafter provided; one of whom shall be a licensed |
18 | human services professional; one of whom shall be a |
19 | representative of the Office of Attorney General; and one of |
20 | whom shall be the Commissioner of Professional and Occupational |
21 | Affairs. |

23 | (c.1) Appointment of licensed human services professional.-- |
24 | Within 90 days of the effective date of this subsection, the |
25 | Governor shall nominate one professional member to serve as a |
26 | human services professional on the board to serve a three-year |
27 | term. The human services professional initially appointed to the |
28 | board pursuant to this section need not have successfully |
29 | completed the licensure examination adopted by the board but, at |
30 | the time of appointment, must have satisfied the educational and |

1 | experience requirements of this act for licensure as a human |
2 | services professional. |

4 | (l) Operating procedures.--The board shall meet within 30 |
5 | days after the appointment of its new members and set up |
6 | operating procedures and develop application forms for licensing |
7 | clinical social workers, marriage and family therapists [and], |
8 | professional counselors, human services professionals and |
9 | provisionally licensed human services professionals. It shall be |
10 | the responsibility of the board to circulate these forms and |
11 | educate the public to the requirements of licensing in order to |
12 | hold oneself out as a licensed social worker, licensed clinical |
13 | social worker, licensed marriage and family therapist or |
14 | licensed professional counselor within the Commonwealth. |
15 | Section 5. Section 6 of the act, amended December 21, 1998 |
16 | (P.L.1017, No.136), is amended to read: |
17 | Section 6. Powers and functions of board. |
18 | The board shall have the following powers: |
19 | (1) To pass upon the qualifications and fitness of |
20 | applicants for licenses and reciprocal licenses and to adopt |
21 | and revise rules and regulations requiring applicants to pass |
22 | examinations relating to their qualifications as a |
23 | prerequisite to the issuance of a license. |
24 | (2) To adopt and, from time to time, revise such rules |
25 | and regulations as may be necessary to carry into effect the |
26 | provisions of this act. Such regulations may include, but |
27 | shall not be limited to, standards of professional practice |
28 | and conduct for licensed social workers, licensed clinical |
29 | social workers, licensed marriage and family therapists |
30 | [and], licensed professional counselors, licensed human |
|
1 | services professionals and provisionally licensed human |
2 | services professionals in Pennsylvania. |
3 | (3) To examine for, deny, approve, issue, revoke, |
4 | suspend or renew licenses of social workers, clinical social |
5 | workers, marriage and family therapists [and], professional |
6 | counselors, human services professionals and provisionally |
7 | licensed human services professionals pursuant to this act |
8 | and to conduct hearings in connection therewith. |
9 | (4) To conduct hearings upon complaints concerning |
10 | violations of the provisions of this act and the rules and |
11 | regulations adopted pursuant to this act and seek the |
12 | prosecution and enjoinder of all such violations. |
13 | (5) To expend moneys necessary to the proper carrying |
14 | out of its assigned duties. |
15 | (6) To waive examination and grant a license in cases |
16 | deemed exceptional by the board and in accordance with |
17 | regulations promulgated by the board. |
18 | (7) To submit annually a report to the Professional |
19 | Licensure Committee of the House of Representatives and the |
20 | Consumer Protection and Professional Licensure Committee of |
21 | the Senate containing a description of the types of |
22 | complaints received, status of the cases, board action which |
23 | has been taken and length of time from the initial complaint |
24 | to final board resolution. |
25 | (8) To submit annually to the Appropriations Committees |
26 | of the House of Representatives and the Senate, 15 days after |
27 | the Governor has submitted his budget to the General |
28 | Assembly, a copy of the budget request for the upcoming |
29 | fiscal year which the board previously submitted to the |
30 | Department of State. |

1 | Section 6. Section 7 of the act is amended by adding |
2 | subsections to read: |
3 | Section 7. Qualifications for license. |
4 | * * * |
5 | (g) Human services professional license.--An applicant shall |
6 | be qualified for a license to hold oneself out as a licensed |
7 | human services professional, provided the applicant submits |
8 | proof satisfactory to the board that: |
9 | (1) The applicant: |
10 | (i) Is of good moral character. |
11 | (ii) Has received a bachelor’s degree or master’s |
12 | degree from an accredited social work program or an |
13 | accredited college or university with a major in |
14 | behavioral science, child or human development, |
15 | counseling, family studies, human services, marriage and |
16 | family therapy, psychology, social welfare or sociology. |
17 | (iii) Has successfully completed 14 courses of three |
18 | or four credits each focused on building the skills and |
19 | knowledge to support the provision of human services, as |
20 | approved by the board. These courses may be part of the |
21 | degree program or post-degree courses offered by an |
22 | accredited social work program or accredited college or |
23 | university. |
24 | (iv) Has successfully completed: |
25 | (A) 450 hours of supervised human service field |
26 | experience as part of a degree program; or |
27 | (B) 2,000 hours of work in a human service field |
28 | under the supervision of a licensed professional, |
29 | such as a psychiatrist, psychologist, social worker, |
30 | clinical social worker, marriage and family |
|
1 | therapist, professional counselor or human services |
2 | professional. |
3 | (v) Has passed a nationally administered examination |
4 | specific to the delivery of front-line human services and |
5 | approved by the board. |
6 | (vi) Agrees to adhere to the National Association of |
7 | Social Workers’ Professional Code of Ethics pertaining to |
8 | the delivery of direct practice social services. |
9 | (2) The applicant has submitted an application |
10 | accompanied by the application fee. |
11 | (3) The applicant has not been convicted of a felony |
12 | under The Controlled Substance, Drug, Device and Cosmetic |
13 | Act, or of an offense under the laws of another jurisdiction, |
14 | which, if committed in this Commonwealth, would be a felony |
15 | under The Controlled Substance, Drug, Device and Cosmetic |
16 | Act, unless: |
17 | (i) at least ten years have elapsed from the date of |
18 | conviction; |
19 | (ii) the applicant satisfactorily demonstrates to |
20 | the board that the applicant has made significant |
21 | progress in personal rehabilitation since the conviction, |
22 | such that licensure of the applicant should not be |
23 | expected to create a substantial risk of harm to the |
24 | health and safety of the applicant's clients or the |
25 | public or a substantial risk of further criminal |
26 | violations; and |
27 | (iii) the applicant otherwise satisfies the |
28 | qualifications contained in or authorized by this act. |
29 | As used in this paragraph, the term "convicted" shall include |
30 | a judgment, an admission of guilt or a plea of nolo |
|
1 | contendere. |
2 | (h) Human services professional provisional license.--An |
3 | applicant shall be qualified for a provisional license to hold |
4 | oneself out as a provisionally licensed human services |
5 | professional, provided the applicant submits proof satisfactory |
6 | to the board that: |
7 | (1) The applicant is of good moral character. |
8 | (2) The applicant has received a bachelor's degree or |
9 | master's degree from an accredited college or university with |
10 | a major in human services, behavioral science, sociology, |
11 | psychology, child development or human development. |
12 | (3) The applicant has submitted an application |
13 | accompanied by the application fee. |
14 | (4) The applicant has not been convicted of a felony |
15 | under The Controlled Substance, Drug, Device and Cosmetic |
16 | Act, or of an offense under the laws of another jurisdiction, |
17 | which, if committed in this Commonwealth, would be a felony |
18 | under The Controlled Substance, Drug, Device and Cosmetic |
19 | Act, unless: |
20 | (i) at least ten years have elapsed from the date of |
21 | conviction; |
22 | (ii) the applicant satisfactorily demonstrates to |
23 | the board that the applicant has made significant |
24 | progress in personal rehabilitation since the conviction, |
25 | such that licensure of the applicant should not be |
26 | expected to create a substantial risk of harm to the |
27 | health and safety of the applicant's clients or the |
28 | public or a substantial risk of further criminal |
29 | violations; and |
30 | (iii) the applicant otherwise satisfies the |

1 | qualifications contained in or authorized by this act. |
2 | Section 7. Section 8 of the act, amended December 21, 1998 |
3 | (P.L.1017, No.136), is amended to read: |
4 | Section 8. Procedures for licensing. |
5 | (a) Affidavit required.--Each application form for an |
6 | applicant submitted to the board for examination or licensure |
7 | shall have attached as part of the form an affidavit or |
8 | affirmation for the applicant to complete as to the veracity of |
9 | the information on the application. |
10 | (b) Issuance of license.--The board shall issue to each |
11 | person who meets the licensure requirements of this act a |
12 | certificate setting forth that such person is licensed to hold |
13 | himself or herself out as a licensed social worker, a |
14 | provisional social worker, a licensed clinical social worker, a |
15 | licensed marriage and family therapist [or], a licensed |
16 | professional counselor, a licensed human services professional |
17 | or a provisionally licensed human services professional. |
18 | Section 8. Section 9 of the act is amended by adding a |
19 | subsection to read: |
20 | Section 9. Exemption from licensure examination. |
21 | * * * |
22 | (d) Human services professional.--The requirements of |
23 | section 7(g)(1)(v) shall not apply and a license shall be issued |
24 | without examination to an applicant who meets one of the |
25 | following requirements: |
26 | (1) Is a licensed clinical social worker, a licensed |
27 | social worker, a licensed professional counselor or a |
28 | licensed marriage and family therapist. |
29 | (2) Is licensed in another state as a social worker, a |
30 | licensed professional counselor, a licensed marriage and |
|
1 | family therapist or a human services professional. |
2 | Section 9. Sections 10 and 12 of the act, amended December |
3 | 21, 1998 (P.L.1017, No.136), are amended to read: |
4 | Section 10. Reciprocity. |
5 | The board shall have the power to grant a reciprocal license |
6 | to an applicant who is licensed or certified as a social worker, |
7 | clinical social worker, marriage and family therapist [or], |
8 | professional counselor or human services professional in another |
9 | state and has demonstrated qualifications which equal or exceed |
10 | those required pursuant to this act in the determination of the |
11 | board, provided that no license shall be granted under this |
12 | section to an applicant unless the state in which the applicant |
13 | is licensed affords reciprocal treatment to persons who are |
14 | residents of this Commonwealth and who are licensed pursuant to |
15 | this act. |
16 | Section 12. Reinstatement of license. |
17 | Unless ordered to do so by Commonwealth Court or an appeal |
18 | therefrom, the board shall not reinstate the license of a person |
19 | to practice as a social worker, clinical social worker, marriage |
20 | and family therapist [or], professional counselor or human |
21 | services professional pursuant to this act, which has been |
22 | revoked. Any person whose license has been revoked may apply for |
23 | reinstatement, after a period of at least five years, but must |
24 | meet all of the licensing qualifications of this act, including |
25 | the examination requirement, if he or she desires to practice as |
26 | a social worker, clinical social worker, marriage and family |
27 | therapist [or], professional counselor or human services |
28 | professional pursuant to this act at any time after such |
29 | revocation. |
30 | Section 10. The act is amended by adding a section to read: |
|
1 | Section 16.4. Restrictions on use of title "Licensed Human |
2 | Services Professional." |
3 | Only individuals who have received licenses as licensed human |
4 | services professionals under this act may style themselves as |
5 | licensed human services professionals and use the letters |
6 | "L.H.S.P." in connection with their names, and it shall be |
7 | unlawful for an individual to style himself or herself as a |
8 | licensed human services professional or use any words or symbols |
9 | indicating or tending to indicate that the individual is a |
10 | licensed human services professional without holding a license |
11 | in good standing under this act. |
12 | Section 11. Section 20 of the act, amended December 21, 1998 |
13 | (P.L.1017, No.136) and July 9, 2008 (P.L.929, No.68), is amended |
14 | to read: |
15 | Section 20. Unlawful practice. |
16 | (a) Unlawful practice prohibited.--It shall be unlawful for |
17 | any person to hold himself or herself out as a licensed social |
18 | worker, licensed clinical social worker, marriage and family |
19 | therapist [and], professional counselor and human services |
20 | professional without possessing a valid, unexpired, unrevoked |
21 | and unsuspended license issued under this act. |
22 | (a.1) Title.--It shall be unlawful for an individual to hold |
23 | oneself out as a social worker, use the title of "social worker" |
24 | or use the abbreviation of "S.W." without meeting the definition |
25 | of "social worker." This subsection includes advertising as a |
26 | social worker and adopting or using any title or description of |
27 | services incorporating the term "social worker" and their |
28 | related abbreviations, which implies directly or indirectly that |
29 | the individual is a social worker. This subsection shall not |
30 | apply to the following individuals: |

1 | (1) An individual employed by the Commonwealth in a |
2 | social work position on the effective date of this |
3 | subsection, during the time of employment by the |
4 | Commonwealth. |
5 | (2) An individual employed as a school social worker in |
6 | a public or private school in this Commonwealth on or before |
7 | the effective date of this subsection, during the time of |
8 | employment as a school social worker. |
9 | (b) Injunction.--Unlawful practice may be enjoined by the |
10 | courts upon petition of the commissioner or the board. In any |
11 | proceeding under this section, it shall not be necessary to show |
12 | that any person is individually injured by the actions |
13 | complained of. If the court finds that the respondent has |
14 | violated this section, it shall enjoin him or her from so |
15 | practicing until he or she has been duly licensed. Procedure in |
16 | such cases shall be the same as in any other injunction suit. |
17 | (c) Remedy cumulative.--The injunctive remedy provided in |
18 | this section shall be in addition to any other civil or criminal |
19 | prosecution and punishment. |
20 | Section 12. This act shall take effect in 180 days. |
