AN ACT
Amending the act of July 16, 1968 (P.L.351, No.173), entitled,
as amended, "An act authorizing the establishment of prisoner
pre-release centers and release plans under the jurisdiction
of the Department of Justice and defining its powers and
duties," providing for eligibility for certain pre-release
centers.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of July 16, 1968 (P.L.351, No.173),
referred to as the Prisoner Pre-release Plan Law, is amended by
adding a section to read:
Section 2.1. Eligibility for Certain Pre-release Centers.--
(a) Any person who is a convicted sex offender shall not be
transferred to a pre-release center located within two thousand
feet of a certified day-care center, registered family day-care
home, licensed preschool program, playground, after-school
program facility or any public, private or parochial preschool,
elementary school or secondary school.
(b) For purposes of determining the minimum distance
requirement, measurement shall be by following a straight line
from the outer property line of the pre-release center to the
nearest outer property line of a certified day-care center,
registered family day-care home, licensed preschool program,
playground, after-school program facility, or any public,
private or parochial preschool, elementary school or secondary
school.
(c) Definition.--As used in this section, the term "sex
offender" means a person who has been convicted of or
adjudicated delinquent of any of the offenses enumerated in 42
Pa.C.S. § 9795.1 (relating to registration).
Section 2. This act shall take effect in 60 days.
