| AN ACT |
| |
1 | Amending the act of July 16, 1968 (P.L.351, No.173), entitled, |
2 | as amended, "An act authorizing the establishment of prisoner |
3 | pre-release centers and release plans under the jurisdiction |
4 | of the Department of Justice and defining its powers and |
5 | duties," providing for eligibility for certain pre-release |
6 | centers. |
7 | The General Assembly of the Commonwealth of Pennsylvania |
8 | hereby enacts as follows: |
9 | Section 1. The act of July 16, 1968 (P.L.351, No.173), |
10 | referred to as the Prisoner Pre-release Plan Law, is amended by |
11 | adding a section to read: |
12 | Section 2.1. Eligibility for Certain Pre-release Centers.-- |
13 | (a) Any person who is a convicted sex offender shall not be |
14 | transferred to a pre-release center located within two thousand |
15 | feet of a certified day-care center, registered family day-care |
16 | home, licensed preschool program, playground, after-school |
17 | program facility or any public, private or parochial preschool, |

1 | elementary school or secondary school. |
2 | (b) For purposes of determining the minimum distance |
3 | requirement, measurement shall be by following a straight line |
4 | from the outer property line of the pre-release center to the |
5 | nearest outer property line of a certified day-care center, |
6 | registered family day-care home, licensed preschool program, |
7 | playground, after-school program facility, or any public, |
8 | private or parochial preschool, elementary school or secondary |
9 | school. |
10 | (c) Definition.--As used in this section, the term "sex |
11 | offender" means a person who has been convicted of or |
12 | adjudicated delinquent of any of the offenses enumerated in 42 |
13 | Pa.C.S. § 9795.1 (relating to registration). |
14 | Section 2. This act shall take effect in 60 days. |
