AN ACT

Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An

2

act relating to tax reform and State taxation by codifying

3

and enumerating certain subjects of taxation and imposing

4

taxes thereon; providing procedures for the payment,

5

collection, administration and enforcement thereof; providing

6

for tax credits in certain cases; conferring powers and

7

imposing duties upon the Department of Revenue, certain

8

employers, fiduciaries, individuals, persons, corporations

9

and other entities; prescribing crimes, offenses and

10

penalties," in personal income tax, further providing for

11

requirements concerning returns, notices, records and

12

statements.

The General Assembly of the Commonwealth of Pennsylvania

14

hereby enacts as follows:

Section 1.  Section 335 of the act of March 4, 1971 (P.L.6,

16

No.2), known as the Tax Reform Code of 1971, is amended by

17

adding a subsection to read:

Section 335.  Requirements Concerning Returns, Notices,

19

Records and Statements.--* * *

(f)  The form for the annual tax return established by the

2

department shall not include an option to file the return as an

3

amended annual return. The department shall provide a form that

4

is separate and distinct from the annual tax return form by

5

which a taxpayer may file an amended annual tax return. The form

6

by which a taxpayer may file an amended annual tax return shall

7

be named and referred to as a PA-40X.

8

Section 2.  The addition of section 335(f) of the act shall

9

apply to tax years beginning after December 31, 2011.

Section 3.  This act shall take effect immediately.
