AN ACT

Amending Title 30 (Fish) of the Pennsylvania Consolidated

2

Statutes, in enforcement, further providing for powers and

3

duties of waterways conservation officers.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 901(a)(12) of Title 30 of the

7

Pennsylvania Consolidated Statutes is amended to read:

8

§ 901.  Powers and duties of waterways conservation officers and

9

deputies.

(a)  Waterways conservation officers.--Every waterways

11

conservation officer shall have the power and duty to:

(12)  When [acting within the scope of their employment,

14

to] in the performance of duty, pursue, apprehend or arrest

15

any individual suspected of violating any provision of Title

16

18 (relating to crimes and offenses) or 75 (relating to

17

vehicles) or any other offense classified as a misdemeanor or

18

felony. They shall also have the power to serve and execute

warrants issued by the proper authorities for offenses

2

referred to in this paragraph and to serve subpoenas issued

3

for examination. All powers as provided for in this paragraph

4

will be limited by such administrative procedure as the

5

executive director, with the approval of the commission,

6

shall prescribe.

Section 2.  This act shall take effect in 60 days.
