| AN ACT |
| |
1 | Relating to confidentiality of Social Security numbers. |
2 | The General Assembly of the Commonwealth of Pennsylvania |
3 | hereby enacts as follows: |
4 | Section 1. Short title. |
5 | This act shall be known and may be cited as the Social |
6 | Security Number Confidentiality Act. |
7 | Section 2. Definitions. |
8 | The following words and phrases when used in this act shall |
9 | have the meanings given to them in this section unless the |
10 | context clearly indicates otherwise: |
11 | "Publicly post" or "publicly display." To intentionally |
12 | communicate or otherwise make available to the general public. |
13 | Section 3. Privacy of Social Security numbers. |
14 | (a) General rule.--No person or entity may do any of the |
15 | following: |
16 | (1) Publicly post or publicly display in any manner an |

1 | individual's Social Security number. |
2 | (2) Print an individual's Social Security number on any |
3 | card required for the individual to access products or |
4 | services provided by the person or entity. |
5 | (3) Require an individual to transmit the individual's |
6 | Social Security number over the Internet unless the |
7 | connection is secure or the Social Security number is |
8 | encrypted. |
9 | (4) Require an individual to use the individual's Social |
10 | Security number to access an Internet website unless a |
11 | password or unique personal identification number or other |
12 | authentication device is also required to access the Internet |
13 | website. |
14 | (5) Print an individual's Social Security number on any |
15 | materials that are mailed to the individual unless Federal or |
16 | State law requires the Social Security number to be on the |
17 | document to be mailed. Notwithstanding this provision, |
18 | applications and forms sent by mail may include Social |
19 | Security numbers. |
20 | (b) Use prior to effective date.--A person or entity that |
21 | has used, prior to the effective date of this section, an |
22 | individual's Social Security number in a manner inconsistent |
23 | with subsection (a) may continue using that individual's Social |
24 | Security number in that manner on or after the effective date of |
25 | this section, if all of the following conditions are met: |
26 | (1) The use of the Social Security number is continuous. |
27 | If the use is stopped for any reason, subsection (a) shall |
28 | apply. |
29 | (2) The individual is provided an annual disclosure by |
30 | the person or entity informing the individual that the |

1 | individual has the right to stop the use of the individual's |
2 | Social Security number in a manner prohibited by subsection |
3 | (a). |
4 | (3) A written request by an individual to stop the use |
5 | of the individual's Social Security number in a manner |
6 | prohibited by subsection (a) shall be implemented within 30 |
7 | days of the receipt of the request. There shall be no fee or |
8 | charge for implementing the request. |
9 | (4) The person or entity does not deny services to an |
10 | individual because the individual makes a written request |
11 | pursuant to this subsection. |
12 | (c) Mailings.--A Social Security number that is permitted to |
13 | be mailed under this section may not be printed, in whole or in |
14 | part, on a postcard or other mailer not requiring an envelope, |
15 | or visible on the envelope or without the envelope having been |
16 | opened. |
17 | (d) Construction.--This section does not prevent the |
18 | collection, use or release of a Social Security number as |
19 | required by Federal or State law or the use of a Social Security |
20 | number for internal verification or administrative purposes. |
21 | Section 4. Prohibition. |
22 | A person or entity may not encode or embed a Social Security |
23 | number in or on a card or document, including, but not limited |
24 | to, using a bar code, chip, magnetic strip or other technology, |
25 | in place of removing the Social Security number, as required by |
26 | this act. |
27 | Section 5. Applicability. |
28 | This act does not apply to documents that are required to be |
29 | open to the public pursuant to any Federal or State law. |
30 | Section 6. Effective date. |

1 | This act shall take effect in 60 days. |
