AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

Pennsylvania Consolidated Statutes, further providing for

sentencing procedure for murder of the first degree.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 9711(d) of Title 42 of the Pennsylvania

7

Consolidated Statutes is amended by adding a paragraph to read:

8

§ 9711.  Sentencing procedure for murder of the first degree.

(d)  Aggravating circumstances.--Aggravating circumstances

11

shall be limited to the following:

(19)  The defendant perpetrated a sexually violent

14

offense as defined in section 9792 (relating to definitions)

15

against the victim and, at the time of the killing, the

16

defendant was required to register pursuant to Subchapter H

17

(relating to registration of sexual offenders).

Section 2.  This act shall take effect in 60 days.
