AN ACT
Amending the act of July 8, 1986 (P.L.437, No.92), entitled "An
act providing for grants to agricultural societies and
associations to develop and improve agricultural fairs;
establishing an advisory committee in the Department of
Agriculture; and making repeals," providing for smoking at
certain agricultural fairs.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of July 8, 1986 (P.L.437, No.92), known
as the Pennsylvania Agricultural Fair Act, is amended by adding
a section to read:
Section 8.2. Smoking at agricultural fairs.
The prohibitions against, and any restrictions on, smoking in
public places under the act of June 13, 2008 (P.L.182, No.27),
known as the Clean Indoor Air Act, shall not apply to any
portion of an annual agricultural fair that is conducted in an
outdoor area of a sports or recreational facility, theater or
performance establishment.
Section 2. This act shall take effect immediately.
