AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, further providing for grading the

3

offense of harassment.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Section 2709(c) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 2709.  Harassment.

9

(c)  Grading.--

11

(1)  An offense under subsection (a)(1), (2) or (3) shall

12

constitute a summary offense[.], and a second or subsequent

13

offense shall constitute a misdemeanor of the third degree.

14

(2)  [(i)]  An offense under subsection (a)(4), (5), (6)

15

or (7) shall constitute a misdemeanor of the third degree[.],

16

and a second or subsequent offense shall constitute a

17

misdemeanor of the second degree.

Section 2.  This act shall take effect in 60 days.
