A RESOLUTION

Directing the Legislative Budget and Finance Committee to study

2

local hotel room taxes that support county and regional

3

tourism marketing and convention centers and to determine if

4

revenues are being appropriated in accordance with applicable

5

statutes.

WHEREAS, The Commonwealth has enacted a number of laws

7

authorizing local taxes on hotel room occupancy to fund the

8

marketing and promotion of business and leisure travel and the

9

construction and operation of convention centers; and

10

WHEREAS, Local convention center authorities and tourist

11

promotion agencies depend on local hotel room taxes as a

12

critical source of revenue for activities relating to tourism

13

and convention centers; and

14

WHEREAS, The General Assembly has set guidelines on the uses

15

of the tax revenue in statutes authorizing local hotel room

16

taxes; and

17

WHEREAS, Since local hotel room tax authority was extended to

18

all 67 counties in 2000, there have been reports of the revenue

being used or being proposed for use on programs other than

2

promoting and marketing tourism and for convention centers; and

3

WHEREAS, In 2005, The County Code was amended to clarify that

4

local hotel room tax revenues must be earmarked for tourism and

5

for other limited purposes as specified by law; and

6

WHEREAS, The appropriate spending of local hotel room tax

7

revenue as required by law is an efficient and cost-effective

8

expenditure of tax dollars that benefits not only local and

9

regional economies but the economy of this Commonwealth as a

10

whole; therefore be it

11

RESOLVED, That the Legislative Budget and Finance Committee

12

be directed to conduct a study of the Commonwealth's local hotel

13

room taxes to determine if revenues are being directed to the

14

proper agencies and are being appropriated in accordance with

15

statute; and be it further

16

RESOLVED, That the Legislative Budget and Finance Committee

17

study include all local hotel room taxes in the following

18

statutes:

19

(1)  The act of August 9, 1955 (P.L.323, No.130), known

20

as The County Code.

21

(2)  The provisions of 53 Pa.C.S. (relating to

22

municipalities generally).

23

(3)  The provisions of 64 Pa.C.S. (relating to public

24

authorities and quasi-public corporations).

25

(4)  The act of December 21, 1998 (P.L.1307, No.174),

26

known as the Community and Economic Improvement Act;

27

and be it further

28

RESOLVED, That the Legislative Budget and Finance Committee

29

report all findings to the House of Representatives no later

30

than one year from the adoption of this resolution November 30,
