INTRODUCED AS NONCONTROVERSIAL RESOLUTION UNDER RULE 35, OCTOBER 5, 2011
A RESOLUTION
Designating October 10, 2011, as "Tenth Amendment Day" in
Pennsylvania.
WHEREAS, While Federal interests and initiatives continually
evolve, certain powers are reserved and rights guaranteed to
states and individuals under specific constitutional provisions;
and
WHEREAS, The Tenth Amendment to the Constitution of the
United States, also known as the States' Rights Amendment,
reads:
The powers not delegated to the United States by the
Constitution, nor prohibited by it to the States, are
reserved to the States respectively, or to the people;
and
WHEREAS, This Constitutional amendment, the final amendment
in the Bill of Rights, was proposed by the Congress of the
United States on September 25, 1789, and ratified by the states
on December 15, 1791; and
WHEREAS, The Commonwealth has asserted its sovereignty under

the Tenth Amendment over all powers not otherwise enumerated or
granted to the Federal Government by the Constitution of the
United States, such as education and local government; and
WHEREAS, The Commonwealth retains authority over its
legislative and regulatory processes in exercising these
reserved powers and shares certain powers with the Federal
Government; and
WHEREAS, The Commonwealth opposes the imposition of Federal
mandates which are beyond the scope of constitutionally
delegated powers; therefore be it
RESOLVED, That the House of Representatives designate October
10, 2011, as "Tenth Amendment Day" in Pennsylvania, setting
aside the tenth day of the tenth month to celebrate the
importance of the Tenth Amendment to the Constitution of the
United States in shaping the governmental, political and
administrative systems of this Commonwealth.
