| A RESOLUTION |
| |
1 | Designating October 10, 2011, as "Tenth Amendment Day" in |
2 | Pennsylvania. |
3 | WHEREAS, While Federal interests and initiatives continually |
4 | evolve, certain powers are reserved and rights guaranteed to |
5 | states and individuals under specific constitutional provisions; |
6 | and |
7 | WHEREAS, The Tenth Amendment to the Constitution of the |
8 | United States, also known as the States' Rights Amendment, |
9 | reads: |
10 | The powers not delegated to the United States by the |
11 | Constitution, nor prohibited by it to the States, are |
12 | reserved to the States respectively, or to the people; |
13 | and |
14 | WHEREAS, This Constitutional amendment, the final amendment |
15 | in the Bill of Rights, was proposed by the Congress of the |
16 | United States on September 25, 1789, and ratified by the states |
17 | on December 15, 1791; and |
18 | WHEREAS, The Commonwealth has asserted its sovereignty under |

1 | the Tenth Amendment over all powers not otherwise enumerated or |
2 | granted to the Federal Government by the Constitution of the |
3 | United States, such as education and local government; and |
4 | WHEREAS, The Commonwealth retains authority over its |
5 | legislative and regulatory processes in exercising these |
6 | reserved powers and shares certain powers with the Federal |
7 | Government; and |
8 | WHEREAS, The Commonwealth opposes the imposition of Federal |
9 | mandates which are beyond the scope of constitutionally |
10 | delegated powers; therefore be it |
11 | RESOLVED, That the House of Representatives designate October |
12 | 10, 2011, as "Tenth Amendment Day" in Pennsylvania, setting |
13 | aside the tenth day of the tenth month to celebrate the |
14 | importance of the Tenth Amendment to the Constitution of the |
15 | United States in shaping the governmental, political and |
16 | administrative systems of this Commonwealth. |
