| AN ACT |
| |
1 | Amending the act of November 10, 1999 (P.L.491, No.45), entitled |
2 | "An act establishing a uniform construction code; imposing |
3 | powers and duties on municipalities and the Department of |
4 | Labor and Industry; providing for enforcement; imposing |
5 | penalties; and making repeals," further providing for |
6 | manufactured housing; adding provisions relating to |
7 | residential buildings with log walls; and providing for a |
8 | report by the Legislative Budget and Finance Committee. |
9 | The General Assembly of the Commonwealth of Pennsylvania |
10 | hereby enacts as follows: |
11 | Section 1. Section 901(a) of the act of November 10, 1999 |
12 | (P.L.491, No.45), known as the Pennsylvania Construction Code |
13 | Act, amended July 7, 2006 (P.L.1052, No. 108), is amended and |
14 | the section is amended by adding a subsection to read: |
15 | Section 901. Exemptions. |
16 | (a) Manufactured housing.--This act shall not apply to |
17 | manufactured housing which bears a label, as required by and |
18 | referred to in the act of November 17, 1982 (P.L.676, No.192), |
19 | known as the Manufactured Housing Construction and Safety |
20 | Standards Authorization Act, which certifies that it conforms to |

1 | Federal construction and safety standards adopted under the |
2 | Housing and Community Development Act of 1974 (Public Law |
3 | 93-383, 88 Stat. 633), nor shall it apply to industrialized |
4 | housing, as defined in the act of May 11, 1972 (P.L.286, No.70), |
5 | known as the Industrialized Housing Act, with the exception that |
6 | any model code enacted pursuant to the Industrialized Housing |
7 | Act shall also have been adopted pursuant to this act and that |
8 | any model code enacted pursuant to the Industrialized Housing |
9 | Act shall not include code provisions specifically omitted from |
10 | adoption pursuant to this act. |

12 | (f) Residential buildings with log Log walls.--Log walls | <-- |
13 | with a minimum average wall thickness of five inches or greater |
14 | which comply with the International Code Council Standard on the |
15 | Design and Construction of Log Structures, ICC 400-2007, or |
16 | other successor standard which the department may specify by |
17 | regulation, shall be permitted in residential buildings if: | <-- |
18 | (1) the area weighted average U-factor for fenestration |
19 | products in the log walls is a maximum of 0.31; and |
20 | (2) (i) the building heating equipment meets or exceeds |
21 | the following Department of Energy ratings: |
22 | (A) Gas furnace - 90 annual fuel utilization |
23 | efficiency (AFUE). |
24 | (B) Oil furnace - 85 annual fuel utilization |
25 | efficiency (AFUE). |
26 | (C) Boilers - 85 annual fuel utilization |
27 | efficiency (AFUE). |
28 | (D) Air source heat pumps - 8.2 heating seasonal |
29 | performance factor (HSPF) split systems. |
30 | (E) For water-to-air geothermal heat pumps: |

1 | (I) Closed loop water-to-air, an energy |
2 | efficiency rating of 14.1 and coefficient of |
3 | performance of 3.3. |
4 | (II) Open loop water-to-air, an energy |
5 | efficiency rating of 16.2 and coefficient of |
6 | performance of 3.6. |
7 | (F) For water-to-water geothermal heat pumps: |
8 | (I) Closed loop water-to-water, an energy |
9 | efficiency rating of 15.1 and coefficient |
10 | performance of 3.0. |
11 | (II) Open loop water-to-water, an energy |
12 | efficiency rating of 19.1 and coefficient of |
13 | performance of 3.4. |
14 | (G) For direct geothermal exchange, an energy |
15 | efficiency rating of 15.0 and coefficient of |
16 | performance of 3.5; |
17 | or |
18 | (ii) the building heating equipment is qualified |
19 | under the Energy Star program jointly operated by the |
20 | Department of Energy and the United States Environmental |
21 | Protection Agency as provided for in 10 CFR Pt. 430 |
22 | (relating to energy conservation program for consumer |
23 | products); and |
24 | (iii) all energy efficiency requirements of this act |
25 | applicable to components other than log walls are met. |
26 | Section 2. The Legislative Budget and Finance Committee |
27 | shall undertake a comprehensive review of this act and submit a |
28 | report on its findings to the Labor and Industry Committee of |
29 | the Senate and the Labor Relations Committee of the House of |
30 | Representatives and the Local Government Committee of the Senate |

1 | and the Local Government Committee of the House of |
2 | Representatives before November 30, 2010. The review shall |
3 | include: |
4 | (1) The process by which the International Code Council |
5 | adopts changes to its codes and subcodes. |
6 | (2) Costs and benefits of triennial adoption of the |
7 | Uniform Construction Code. |
8 | (3) The composition of the Uniform Construction Code |
9 | Review and Advisory Council and the process by which it |
10 | reviews and recommends changes to this act. |
11 | (4) The process of administration and enforcement of the |
12 | Uniform Construction Code. |
13 | (5) The fee structure of the Uniform Construction Code. |
14 | (6) The process, including time frames, by which the |
15 | Department of Labor and Industry adopts the Uniform |
16 | Construction Code. |
17 | Section 3. The addition of section 901(f) of the act shall |
18 | expire June 30, 2011. |
19 | Section 4. This act shall take effect immediately. |
