| AN ACT |
| |
1 | Requiring background checks of persons who coach youth athletic |
2 | teams. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Background checks. |
6 | (a) Requirement.--A person who seeks to coach a youth |
7 | athletic team which is organized and supervised by a |
8 | recreational youth athletics organization or entity shall |
9 | provide to the organization or entity a background check which |
10 | reports whether the potential coach has a criminal or abusive |
11 | history. |
12 | (b) Criminal history.--A potential coach, to satisfy the |
13 | requirement of subsection (a) regarding criminal history, shall |
14 | provide a report of criminal history record information from the |
15 | Pennsylvania State Police or a statement from the Pennsylvania |
16 | State Police that the Pennsylvania State Police central |
17 | repository contains no such information relating to that person. |
18 | The criminal history record information shall be limited to that |

1 | which is disseminated pursuant to 18 Pa.C.S. § 9121(b)(2) |
2 | (relating to general regulations) and shall be no more than one |
3 | year old. |
4 | (c) Abusive history.--A potential coach, to satisfy the |
5 | requirement of subsection (a) regarding abusive history, shall |
6 | provide an official clearance statement obtained from the |
7 | Department of Public Welfare within the immediately preceding |
8 | year as to whether the person is named as the individual |
9 | responsible for injury or abuse in an indicated report or a |
10 | founded report. |
11 | (d) File.--The recreational youth athletics organization or |
12 | entity shall maintain a copy of the required information for so |
13 | long as the person coaches for the organization or entity. |
14 | Section 2. Effective date. |
15 | This act shall take effect in 60 days. |
