AN ACT

Amending the act of April 9, 1929 (P.L.177, No.175), entitled

2

"An act providing for and reorganizing the conduct of the

3

executive and administrative work of the Commonwealth by the

4

Executive Department thereof and the administrative

5

departments, boards, commissions, and officers thereof,

6

including the boards of trustees of State Normal Schools, or

7

Teachers Colleges; abolishing, creating, reorganizing or

8

authorizing the reorganization of certain administrative

9

departments, boards, and commissions; defining the powers and

10

duties of the Governor and other executive and administrative

11

officers, and of the several administrative departments,

12

boards, commissions, and officers; fixing the salaries of the

13

Governor, Lieutenant Governor, and certain other executive

14

and administrative officers; providing for the appointment of

15

certain administrative officers, and of all deputies and

16

other assistants and employes in certain departments, boards,

17

and commissions; and prescribing the manner in which the

18

number and compensation of the deputies and all other

19

assistants and employes of certain departments, boards and

20

commissions shall be determined," removing references to

21

certain boards of trustees.

The General Assembly of the Commonwealth of Pennsylvania

23

hereby enacts as follows:

24

Section 1.  As much as relates to the Department of Public

25

Welfare in section 202 of the act of April 9, 1929 (P.L.177, No.

26

175), known as The Administrative Code of 1929, amended July 9,

27

1986 (P.L.547, No.97), is amended to read:

Section 202.  Departmental Administrative Boards,

2

Commissions, and Offices.--The following boards, commissions,

3

and offices are hereby placed and made departmental

4

administrative boards, commissions, or offices, as the case may

5

be, in the respective administrative departments mentioned in

6

the preceding section, as follows:

Section 2.  Section 401 of the act, amended November 26, 1997

19

(P.L.530, No.57), is amended to read:

20

Section 401.  Boards of Trustees of State Institutions.--(a)

21

The boards of trustees of each of the State institutions

22

hereinafter mentioned shall consist of nine members, and the

23

head of the department having supervision over the institution

24

ex officio.

25

(b)  The terms of each member of each such board shall be six

26

years, and until his successor is appointed and qualified.

27

(c)  All members of all boards, appointed to succeed members

28

who have served six year terms, shall be appointed for terms of

29

six years from the date of the expiration of the preceding term.

30

Vacancies happening before the expiration of a term shall be

filled for the unexpired term.

(d)  Five members of any such board shall constitute a

3

quorum.

4

(e)  Each such board shall annually elect a president and

5

vice-president from among its members, and a secretary and

6

treasurer who need not be members of the board. The secretary

7

and treasurer may be the same person.

8

(f)  This section shall apply to:

11

Board of Trustees of Scotland School for Veterans' Children,

12

Board of Trustees of Pennsylvania Soldiers' and Sailors'

Board of Trustees of the Western Youth Development Centers,

16

Board of Trustees of the Central Youth Development Centers,

17

Board of Trustees of the Eastern Youth Development Centers,

18

Board of Trustees of Allentown State Hospital,

Board of Trustees of Clarks Summit State Hospital,

20

Board of Trustees of Danville State Hospital,

21
